United Nations DECLARATION on the RIGHTS of INDIGENOUS PEOPLES

I would like to share and extract some part of the UN DECLARATION on the RIGHTS of INDIGENOUS PEOPLES pertaining to rights over their land.
The purpose of this article is for EDUCATION and AWARENESS for fellow Dayakbaru.
Article 32
- Indigenous Peoples (IP) have the right to determine and develop priorities and strategies for the development or use of their lands or territories and other resources.
- States shall consult and cooperate in good faith with the IP concerned through their own representative institutions in order to obtain their free and informed consent prior to the approval of any project affecting their lands and territories and other resources, particularly in connection with the development, utilization or exploitation of mineral, water or other resources.
- States shall provide effective mechanisms for just and fair redress for any such activities, and appropriate measures shall be taken to mitigate adverse environmental, economic, social, cultural or spiritual impact.
Dayakbaru – you will realized that many of our IP rights has been infringed and abused by the BN State Government of Sarawak.
Should we allow the BN to carry on with this infringement and abused or we stop BN by voting them out, starting with Batang Ai?

Hello Dr John,
The definition of IP according to Oxford Advanced Learner Dictionary is to describe the people or population of the original inhabitant of the place. Another words for IP are aborigine or native.
Let talk who is the real native of Sarawak. If the dividing timeline is mid 1850s, the Ibans were still in Kalimantan Borneo, in Sanggau and Putussibau in Central Kalimatan during that period. Probably, the Rajang people ( speaks 80% dialect of Melanau Kuala Rajang), living in the Kanowit area. I think Seliong ak Wau had many school mate of Rajang while studied in SEDAYA. While the Kayan, Ukit were residing along the upper Batang Rajang around Song and Kapit area.
If the timeline is 1900, when the Foochow flooded the Sibu and Sarikei areas, and considered them IP under UN definition will cause a devastating effect on the Iban. Our share with other bumi is getting more competitive and probably bubbled out to our last breath within the short moment (jengap2 baka ikan mabuk amboh). Foochow which is widely known as the Jews of the East, is happy with the UN definition. The Iban will die standing, like the aborigine in Australia. In Miri they were few Indian (tambi), came as early 1900, mainly selling cloth (jual kain). They were also qualified by to IP too.
So, please the Iban, use your head before heading for the disastrous change. The UN definition may be not benefit the Iban at all. Probably the definition of IP by present gov’t is fair and good for every peace loving Malaysian.
In short the UN IP definition is only applicable to super power like US and UK or few greedy local politicians. Take Sabah for example, the data on population is now no more described according to indigenous group Keadazaan, Dusun but described Muslim Bumi and Non Muslim Bumi and Non Bumi. I guessed you know what I am trying to say….

The main point is; Do we have any rights to anything at all? Do we have property rights to our personal belongings, our land or maybe to the exreme; ourlove ones ? The UN recognize the rights of the indigenous people to their land, us to our NCR land because we are the natives of Sarawak as enshrined in the Constitution…be grateful. We resent the actions to erase our rights to our NCR land by the state and federal BN govt. Some of our native community leaders are brainwashed into beleiving that we are PENUMPANG on this land. If WE, the natives, believe that we have no rights anymore then we deserved to be treated as slaves the last 45 years and many more years to come. The Dayaks are indeed one of the indigenous people of Borneo Island. The border between Sarawak and Kalimantan Borneo was created by the colonial powers for their own gain.Our great great grandparents were already here.We mind our own right and defend if with all our might.

I admit my preference to reading and writing financial papers, but for JJawa’s mention of my name I wish to add something else.
On 30th January2009 I was invited to the Dayak’s symposium in Sibu and presented some thoughts on Dayak’s economic challenge. Other than that small contribution I was absorbing information that still remains as syrupy quagmire in my head, especially on the part that the word “Dayak” MIGHT be obliterated from Sarawak’s legislature.
1. Where is the word “Dayak” used other than in Borneo? Let’s not mention Malaysia’s Sarawak or James Brooke’s Sarawak yet because these were recent events of history (eg watershed boundary between Bristish and Dutch).
2. Ancestral origin of Dayak is Borneo. No history ned to document that because when James Brooke landed in Sarawak around 1830’s, the Dayaks were already in this Northern section of Borneo. The fact James Brooke was made governor by Sultan Omar Sarifudin (correct me if my history is wrong) in or around 1841 was because of the presence of “Sea Dayaks,” pirates, the “lanun” who were my ancestors, and J Jawa’s ancestors as well. You can always go backward changing the time-line, but no one, repeat no one can ever conclusively establish if the Sea Dayaks were not part of northern Borneo even back to the Majapahit era.
3. Dayak migration from Kapuas outward to other regions “could” have been accelerated by wars, search for new land and krakatau 1883 (lampong pecah), but it did NOT start in 1850. I may not be an anthropologist, but I have this strange premonition that proponent for “Dayak” obliteration from the constitution is already at work.

Ngah diatu pen kitai nyau bekechai berai ngeringka serakup masing masing lalu serakup besai SDNU nyau enda dikibuhka.

Like the indigeneous Dayak eat fellow Dayak, or let other Dayak being planted to defeat fellow Dayak, or betray own Dayak voters to frog around, or put blind eye on land grabbing from the Dayaks, or neutralise your own fellow Dayak just like netralising Buah Kepayang etc.
