MAFREL (Malaysia for Fair & Free Election) statement

Report Compiled by a member of MAFREL

I am now backed in Kuching after spending 8 days in Batang Ai observing the by-election conducts. And as far as our term of references (which is very limited) is concerned we are more or less done, 3 days before polling.

Why I said we are done, because there is nothing to observe anymore. What happen in the next few days will be of no different. Riggings in this by-election are rampant and sad to say that the words “CLEANS, FAIR & FREE ELECTION does not exist in Batang Ai by-election vocabulary.

Our report and photographs taken during our stint in Batang Ai have been compiled and submitted to our Head Quarters in KL.

MAFREL (Batang Ai) had reached a conclusion that Batang Ai by-election is where politic is at its worst.

It’s here that money politics rear its ugly head. By all accounts I dared says that Batang Ai by-election is the dirtiest, most unfair & expensive in Malaysian election history.

We observed that:

1) During nomination day (29/3/09) we felt that the police should not have confiscated PAS flags, only returned after vehement protest from PKR. What puzzled us most was why the police allowed SUPP flags among the BN crowd. Report and photos taken during the incident has been submitted to HQ KL for further action.

2) BN candidate election posters were pestered a day before the nomination date. This is a gross defiance of the by-election conduct. We had taken photographs of those posters at Ng. Mepi longhouse. This was by no mean an isolated case because we found the same in other longhouses.

3) It was common sight to see BN giving away gifts of all sorts to the people in the constituency. We have pictorial evidences to that effect but I don’t think its wise me to disclose them here.

4) Misused of government vehicles is very rampant and seem to be an acceptable norm among BN officials. We took photos of not less than 47 SG vehicles either parked near the BN “ceramah” or near their operation rooms since nomination. During the nomination day alone we sighted not less than 120 SG vehicles not far from the nomination centre.

5) Civil servants, Departmental heads, teachers appears to be parts and parcels of BN election machinery. They are being deployed and mobilized to every longhouses and corners of Batang Ai.

6) MAFREL (Batang Ai) hereby confirmed the talks that “Tuai Rumah” or longhouse chief are being “kidnapped” and held hostages at Batang Ai Hilton. Some of those whom I met reveal that they are given RM1,000.00 pocket money during the duration of their stay. Some who chose to go to Kuching for sight seeing are given more. We observed that this is indeed very effective tools deployed by BN politician to entice voters. If not money politics, bribery what then?

7) As expected BN ministers continuously poured in “instant noodle projects and other goodies” virtually to all 121 longhouses in Batang Ai. As far as MAFREL is concerned, this is a daylight bribery. Again we have more than enough evidence to support our claims. It’s now up to HQ to make the necessary dis closer.

8) Our monitoring unit reported that BN campaigners have contravened particular section of the by-election Act whereby they placed BN flags on the bridge and other prohibited places.

9) We also received report that BN supporters/campaigners pulling down PKR flags at the entrance of a particular longhouse. At the time of reporting police report has been lodged.

10) By MAFREL (Batang Ai) estimation the cost of this by-election far acceded the allowable amount of RM150K by contending parties.

11) We also reported & recorded scares tactic employed by BN Ministers esp. by Jabu, Masing, Awang Tengah, Awang Asfia, Salang, Entulu , Gramong Juna , Fadillah and few others during their “ceramah”.

12) We had examined and scrutinized the voter lists, found out that 111 years old voter still appear in the electoral roll. We checked with NRD and our trip to a grave yard confirmed that this particular voter died some 30 years ago. We have communicated our findings to the EC and believed that this is by no mean an isolated case.

13) We also received complaints from the longhouse residents that some of the names are missing from the electoral rolls. We are still investigating their claims.

14) Intelligence information received from the ground suggested that there will be more longhouses after the by-election. Reasons: Batang Ai by-election will cause a split among longhouse folks leading to the formation of new residence/longhouse.

15) In 1996 election, Donald Lawan successfully challenged Mong Dagang in the court as a result of practicing money politics. Will the 2009 Batang Ai by-election provides another same scenario of Jawah Gerang Vs. Malcolm Mussen, not only in Batang Ai battle field but also in court battle? NOT impossible if MAFREL (Batang Ai) reports and findings are anything to go by.

16) I must say within our term of references, the 26 Mafrel observers have done a splendid job as an election watch dog despite the numerous hurdles and handicaps.

    I do hope Mafrel headquaters in KL will take appropriate action, includes transmit the reports to Election Commission and MACC.

    Giving money or any gift, free food and free lodging to tuai rumah put up at the five-star hotel during the election period is for what purpose if not tried to influence them in favour of any person or any political party contesting in the election. I see it as an act of corruption as defined under the Prevention of Corruption Act.

    In my opinion, MACC has to investigate on any information given by the public in the media if there are elements of corruption not necessary to act only on an official report lodged by anybody. We have heard people always accuse MACC of double standards and not consistent in their investigation, for instance MACC is fast to act on any report made by Barisan Nasional, but slow to respond to any report made by the opposition.

    The people hope that MACC will carry out its duties in a professional manner, without fear or favour.

    Don’t able be a candidate if they don’t have such a big amount of money in the pocket or where able it is , Do MAFREL want to pay all our expenses during our involving during the campaign ? We work for money ..as like YOU as a singer also go for single bloody fucking money …Is it right PJJ ?
    I don’t work for FREE…. as all of us should provide something for our families …safe your life before you safe others…. These are all BULLSHIT…They RAKYAT should receive from candidate as no work done is FREEeeeeeeeeeeeeee ..!!##@@^^**$$

    In one way, I do not mind this by-election as I could see a lot of easy money coming from the sky is being poured in to the longhouse folks. Never before these people have been such a big amount through various projects through BN promises. And also never before such BIG GUNS come to LA to see for themselves the plights of our people all this while. It would be nice if all of these projects or promises by the BN could be implemented before the election.

    If indeed, BN could do so, then it is quite great. I certainly would like to see a number of by-elections in our Iban rural areas like Saratok, Julau,Baleh,Katibas Pelagus and Baleh conducted one after another so that BN government will pour in more “Instant noodles” development in the areas. ONLY this way our community could benefit directly from the concept of POLITICS OF DEVELOPMENT envisaged by our Buban, Abu Umpang & Asing Emut.

    If however you could not foresee the immediate implementation, then VOTE for PKR for a CHANGE….

    We must change……

    Bisi ga panadak bala MAFREL tu nih. Kati enda ngumbai sida dadak, sida nganjung riput ngagai indu opis sida di Malaya din madahka pangundi ke beumur 100+ taun nya udah mati kurang lebih 30 taun ke udah lalu pendam tudah nya amat-amat “dibuktikan” sida enggau gambar.

    Tang bisika sida MAFREL nya mansik sekalika tudah ke mati tang nama iya agi ba list pengundi nya bisi ditemu ngundi/nurun ngundi ba tetiap kali bepilih sepengudah iya ke parai?

    Enti iya nadai rekod ngundi/nurun ngundi sepengudah iya parai reti nya iya ukai pengundi antu tang nama iya lalu bedau dibuai ari list pengundi.

    Tang enti sepengudah iya ke mati nya tak agi ga bisi rekod nunjuk ke iya agi bisi ngundi maya tetiap kali bepilih..reti nya amat-amat bisi mih orang nyaru ngena nama iya nyadi pengundi antu.

    Nya alai demalam Amit Lebar bulih amat bejaku besalah bala MAFREL!!

    TQ. for fighting your Civil Right which is part of Dayak Right.

    I hope Dayakbaru can get this report and submitt to UN where the Civil Right and Human Right are preserved.

    “The Election Commission’s decision not to count the ballots at 14 of the 26 polling stations in the Batang Ai constituency after the by-election tomorrow has drawn strong objections from election watchdog Malaysians for Free and Fair Elections (Malfrel) and PKR.”

    So, what makes the other 12 polling stations so special? Why are the other 14 polling stations are not being treated the same way? Is this kind of manouver under the current Perintah BN fair to all the voters in Batang Ai?

    A lot of well informed voters will be “pissed off” with this kind of action and will work more the harder towards a truly democratic and fair Government.

    Based on the report by MAFREL, the Barisan National (BN) candidate & campaigners had contravened the rules & regulations stipulated in the by-election Act and some of their actions already proven guilty even before the polling process.

    If the report by MAFREL is genuine, I wish that Election Commission will revoke the result if BN candidate wins the by-election and call for a fresh election.

    There has never been any fair elections in Malaysia. The fact that BN uses instant carrot during any election is already a corrupt move by them. Big companies involved in timber extraction would finance them during the election amounting to millions of ringgit and these companies will claim our land and our forest in return.

    Remember Mahathir’s time in Sabah, illegal immigrants became Malaysian citizens in a matter of hours.

    Just pray to God that such arrogant and power greedy will be punished by God one day.
