A Reflection of What Happened to the First Dayak Chief Minister

Consider these two events:
1. When Anwar propose no-confidence vote for Pak Lah as PM, the Dewan Rakyat Speaker reject it as only PM can consider that motion and not the Speaker.
2. But for Perak DUN, the BN-appointed Speaker call emergency sitting to file motion deemed fit by the Speaker to protect by any means for BN stronghold on Perak DUN even on their majority gained through deceit of defection.
Ningkan was unlawfully removed as CM
Two different unique roles of Speaker contradict itself by virtue of principle.
Then the case precedent of Ningkan in which this Nizar’s role as MB being reinstated. Our 1st CM and 1st and last ‘truly’ Dayak CM, Stephen Kalong Ningkan being removed by Sarawak TYT (Tun Openg, father of Abg Johari Openg Housing minister now) of losing the majority but Court ruled that the signature letters of 21 of 42 ADUN is not binding so proper DUN motion must be filed in order to remove the CM and CM post is vacant.
Emergency Rule – why?
But Ningkan refuse to step down which lead the emergency rule being imposed by TYT. Somebody hate to see Dayak hold power is up for anyone guess, truth is in the pudding.
BN Need to learn to Respect the law and rules
It is pivotal for CM post is VACANT first and foremost then the next CM can be appointed. That is the case of all legislature where DUN is dissolved, nobody held any post until after the election then appointment can follow, same applies in event of defection where new MB must be appointed as new majority leader.
Can Appoint but cannot Remove
Nizar counsel Sulaiman is right when raised that Sultan can appoint MB but cannot remove or sack him. That’s mean only the people’s vote can appoint new MB. It’s all goes back to the people and Nizar have the right to request DUN dissolvement at any time to determine who really command majority votes and support from the people, not the DUN members by means of deceit if principle of voters choice at time of election take into effect.
Voter votes are sacred
The voters vote the ADUN for that particularly party and not vote the ADUN to defect later. That is cheating your pledge and voters don’t deserve it so that ADUN must quit and let voters choose their new ADUN fit for them again.
Go Back to the people – to gain power
Sultan probably erred big time here but looking how circus-wild the situation now, Sultan must consent for dissolvement and call fresh election. There is no question of funds wastage as EC money all paid by people money and what better expenditure to spend their money to get their voice back.
Note that how much PKFZ scandal cost of RM8-12 billions of people money lost and burned, it’s a minute small candy cost to hold election again.
It’s all back to the people. People first, performance now. Sounds familiar right.

Siapa Yang Berhak/ Siapa yang Sah?
Pandangan seorang yang tidak memihak(Neutral).
BN= 28 DUN & PR= 28 DUN, Ind.= 3 DUN.
-3 Dun PR keluar Parti jadi Ind.= Sah/Berhak.
(tiada pertikaian/tiada halangan boleh keluar/lompot Parti hak peribadi)
-3 DUN PR yang keluar Parti sudah sign/tanda tangan surat sumpah letak/kosongkan jawatan DUN jika keluar Parti adalah Sah dan beretika.
( Tidak ada halangan/larangan dia keluar/lompat/masuk parti lain boleh/dibenarkan tetapi perlu letak jawatan DUN seperti yang dipersetujui dalam surat sumpah dan perlu diadakan Pilihan raya baru bagi 3 DUN Ind.tersebut saja)
-Tidak perlu diadakan dibubarkan DUN Perak ataupun tidak perlu diadakan Pilihan Raya Negeri secara keseluruhan. Cuma yang perlu/sah/layak diadakan Pilihan Raya semula adalah 3 DUN PR yang keluar Parti jadi Ind. Supaya yang terbabit perlu ikhlas/ beretika/jujur tak perlu membazir kos Pilihan Raya Negeri secara keseluruhan.
-Mahkamah Persekutuan/High Court mengesahkan/memutuskan Nizar adalah MB yang Sah bermaksud Dr Zamri adalah tidak Sah.Kerajaan Negeri Perak BN adalah Tidak Sah!.Keputusan/Perutusan Sultan Aslan Tidak Sah! Semua keputusan MB Zamri semasa rampas kuasa selama ini adalah tidak Sah! Tidak Sah! Dalam hal kemelut ini Mereka BN buta kebenaran/tidak jujur/tidak beretika/menyesat dan mengelirukan rakyat dan Gila Kuasa! Gila Kuasa!
With the ruling of Kuala Lumpur High Court recently to declare Datuk Mohd. Nizar was the rightfful menteri besar of Perak, it seems that there are two governments and no opposition.Both Barisan and Pakatan using courts on legal battles and there are appeals and counter-appeals by both sides.When all of this will end?It will continue and the losers will be the people of Perak.
Deputy Prime Minister Tan Sri Muhyiddin Yassin said he was worried if the Perak crisis dragged on for so long because the problem will affect the people`s well being. I think, the Deputy Prime Minister knows that using courts to end the political crisis in Perak will take years. Why he does not suggest to dissolve the Perak state legislative assembly to pay the way for a fresh election by giving power back to its people to elect a new government. For me, it is not an issue that the election is draining resources and a waste of public funds, instead it is a price the country pay for a funtioning democracy.
As Tengku Razaleigh Hamzah said in his blog….it is better for BN to risk state elections that we may lose rathan than to lose the entire country by being seen to be opposed to decency, the rule of law, and the will of people.
Court of Appeal has not yet fixed for a date to hear Datuk Dr. Zmbry`s appeal against the Kuala Lumpur High Court decision declaring Datuk Mohd. Nizar the rightful Perak menteri besar. In my opinion, should the Court of Appeal later dismisses the appeal by Datuk Dr. Zmbry, BN

Nizar said that the assembly sitting called by BN on 7.5.09 was illegal, meaning all the decisions in the proceedings were invalid, including the appointment of Ganesan as a speaker. As I can see it, in the meantime, UMNO leaders prefer the Perak political crisis be settled by legal process hoping the court decisions in their favour.
Should Court of Appeal dismiss Dr. Zambry`s appeal and upholds the Kuala Lumpur High Court ruling, I think Dr. Zambry has two options:-
i) appeal to Federal court and
ii) to table a motion of no confidence against Mohd. Nizar. If this happens, we can see the assembly will turn to a `fish market` again.
The three frog Adun’s pre-signed resignation letter (in the event they defect jumping) also deemed invalid by Election Commission which is utter nonsense before being challenged, appealed in court. As they signed the letter without on ground of coercion, insanity, by forced bullet to head the letter should applied as they know once the defect they agreed to quit for by-election. It is a binding agreement.
There are always two sets of law, one for BN (lightning speed service) and one for Pakatan (semadi nadai service).
How BN can call for emergency DUN meeting when court decide Nizar still the MB but the appeal by Zambry just remark on stay on execution and did not state Zambry the MB. It is just a pending on action, Nizar is the MB.
This is what happen when judiciary can interfere DUN operation when separation of powers clearly draw the line. BN set a bad stupid precedent. Now any YB can challenge Speaker’s decision or actions which is unheard of in any democracy. And the Sultan also become indifferent on approving majority by crooked means or by deceit which mean Agong cannot refuse Anwar’s request for Federal takeover when the MPs are enough to defect from BN to Pakatan. If BN can show Sultan the new majority bypassing Pakatan under their nose so why not Pakatan show Agong that Pakatan have more than enough MPs majority in Dewan Rakyat?
The end game is how you play your poker cards. BN may get 3 aces but Pakatan can line up royal flush. Winner takes all in Texas Hold ‘Em up poker.
Who do we trust in?
- Every body is seem to be a liar! Liar! Two set of Law/ two set of rules that contradicted one another or was blindly follow or wrongly inforce! on the eople or the victims.
We can not trust the BN.
We can not trust the Government.
We con not trust the Opposition/Senator.
We can not trust the MP.
We can not trust the YB.
We can not trust the Sultan/TYT.
We can not trust the Agong.
We can not trust the CM/MB.
We can not trust the Officers.
We can not trust the Judges/Lawyers.
We can not trust the Police/inforcer.
We also can not trust the Law to protect us.
We can not trust the Devil or the Satan can not be trust in.We are hopeless or in doom! for ever?
He( Satan/Devil) is the father of Liar!Liar! & Injustice! Injustice!
Even God or Allah, people can not trust in? Kerana orang yang bukan Islam tidak dibenarkan(Haram) sebut/panggil nama Allah.
The only person that we can put our trust in is Jesus Christ our Lord(Tuhan). The saviour who care for you and me. He Forgive and save those sinners if they repent from their sin. Heaven is the only Place for those who put their trust in Jesus or receive Him as their Saviour. Amen!

Another interesting article by Borneo Post today by Paul Sir on this Kalong Ningkan case. First of all this a typical BN ball-polishing as reminder first.
In that article, the judge decision to declare Nizar as MB is different than the case precedent being referred (Kalong Ningkan case) because Perak crisis involve change of state government between BN vs Pakatan whereas Kalong Ningkan case involve no change of political partisan or Sarawak state government as the new and 2nd Sarawak CM then (Tawi Sli) still from the same party as Kalong Ningkan. A totally different scenario as the article argued.
You know what Dayaks? This is typical BN-style to smokescreen us from the truth. While the serious implication of the status of government is noted, the article failed to upheld the principle of orderly manner in vacating such a pivotal and important post of MB/CM. There is must an order or chaos will happen like case of Perak. CM post cannot be overlapping while still NOT VACANT. If Sultan can straight away appoint a new MB without vacating the MB post, then anybody can become MB in and out. The whole process restart again, disrupting civil administration to whom they must obey just to install a new MB at whim and fancy. It is the same principle applied even if the new CM is from the same party. The CM post must let vacant or anyone from ADUN members can be appointed as they wish for whatever reason of commanding majority. If that happen then there is no order in DUN as it will become circus, Sultan can appoint new MB anytime, the current MB can be dismissed anytime without the need for no-confidence vote etc. The arguement of the same-party also doen’t mean a consent to such practice in bypassing confidence vote.
A divorcee can only remarried once they finalised his/her divorce. He/she cannot married new partner while still legally bind to current marriage without dissolving it. Cannot be married for two partner lah.
This is how Borneo Post hoodwinked some of the unsuspecting readers by diverting the real principle of the importance of vacating MB post by putting the same-party(Kalong Ningkan and Tawi Sli) arguement as somehow irrelevant to Perak case. But the article did mention the veiled reason of Ningkan dismissal as ‘plot’ by Umno. Yeah right a plot and Tawi Sli just white knight poison pill within the same party to end Dayak’s possibility of political dominace by majority to allow the rule of Melanau minority from the same Yaakub dynasty and the rest is pathetic Dayak history. And how convenient for Borneo Post to miss that!

Why in the 21st century Dayaks prefer to become humble instead of ferocious? Could that lead to many bad omens such as (in simple words):
1. dayaks easily abused by non-dayaks with no limit,
2. sparingly used by the rich & famous,
3. bullied by authorities (govt agencies),
4. cheated by Dayak YBs,
How we regain the spirit & status of our warriorness, agi idup agi ngelaban?
