The Sarawak government has been accused of deliberately misinforming the prime minister on the row over native customary rights (NCR) in the state.
“I am sure the prime minister has been ill-informed on the true situation of NCR land issues,” said Sarawak National Party’s Stanley Jugol in responding to a statement made by Najib Abdul Razak on the issue.
Najib, who was on a two-day visit to Sarawak, had assured the Ibans in Lubok Antu that the government would not snatch their land away.
“We have no intention of grabbing anybody’s land. The Ibans should not worry. The BN government will not take away your property,” he had told a huge gathering in Nanga San, Lubok Antu, about 250km from state capital Kuching.
“We want to ensure the future of the Ibans and we will solve the land problem that I know you are concerned about. You can have confidence on the BN government.”
However, Stanley pointed out that there are currently hundreds of disputes over NCR land before the courts.
“What will happen to the NCR land that has been taken away from the natives? The proof of this is the fact that there are more than 200 cases of NCR land filed by the natives against the government and companies. These cases are pending hearing.”
“I am sure the state government leaders are not telling the truth when they briefed the prime minister,” he said.
Native customary rights to land in Sarawak is a system of land tenure based on ‘adat’ (native customary laws), allowing the natives the right to cultivate the land and to benefit from the produce of the jungle, including hunting and fishing.
Stringent opposition to state’s NCR model
Under a government scheme, more than one million hectares of land – the bulk of which is NCR land – have been leased to companies for 60 years for the planting of oil palm.
Najib said that from his discussions with Chief Minister Abdul Taib Mahmud, he was convinced that the state’s NCR model would bring development to the Dayaks, particularly the Ibans.
But what Najib was not told was that there has been stringent opposition from the natives to the NCR land development promoted by the state government.
Under that scheme, only 30 percent of the equity is given to landowners, while state government-linked company Pelita Holdings has 10 percent, and the lion share, 60 percent, goes to investors.
Moreover, although the landowners hold 30 percent, they are in the dark about the management of the plantations as they are not included in the decision-making of the company.
“The Ibans are against this concept,” said Stanley.

More than 200 cases of NCR land filed by the natives against the government and companies still pending more than 10 years. Ask Najib, Taib and BN why? Can they answer this question?
This land is very hard to comprehend with. If you left this land idle it doesn’t benefit anyone. If we have our own capital to start with, well BN gomen did not stop you of planting whatever you think can have a good return with this land.
BN gomen is always thinking how to improve the economy of these owner of this native land. This land not only hard to comprehand with but also very complicated to deal with at the same time. There are so many claimant of this land among the native families themselves. Dayak Iban were practicing shifting cultivation not long ago and they have a nomadic lifestyle as well.
BN gomen is still fining tune to get both the owners and the developers to optimize fortune what can come out of this land.

Stanley is to be commended for speaking out the truth.
In addition, he could also mention the most glaring and inexplicably oppressive of NCR laws:
why Dayaks are not only, not allowed to be given land title in the routine sense of the word-according to West Malaysia National Land Code, but are not even allowed by State Law, to initiate community surveying for lands which have been cultivated with rubber, cocoa, pepper, padi …and for land where longhouses stand… for generations, indeed before Malaysia itself !
I think, pursuant to his 1Malaysia, PM Najib need to open his eyes and ears beyond Taib, but to the rest of the poor Dayak massess. He could be visiting and seeing the folks at Batang Ai, and still not “seeing” the truths for what it is.
Especially if many Dayak allowed themselves to be too mesmerized and too dumbfounded by the YBs visiting their longhouses, to continue to challenge and ask questions.
Its gratifying to note that many Dayaks have become more educated on their NCR land rights and pursue their rights in court, instead of taking the law into their own hands, as in the tragic Niah case.
True-blooded Dayak of every political persuasion should bring the issue of NCR land at Federal level and to accord the same protection of NCR land as Malay reservations, Malay holdings, wakaf, sultanate, bait-ul-mal…
The 10/60/30 for Pelita/Investor/Dayak split does not even provide as much benefit for the Dayak as it does the Investor and Pelita. 10 years of ZERO divident, and 50 years of stunted capacity upbringing for Dayaks to acquire agribusiness skills.What will happen on the 61st year ?
We may just know the words corrupt, oppressive, unfair because learnt by hearing but not experience. If go to some places on earth to countries like Republic Of Congo, Gabon, Nigeria then you may know what you are talking about. The police officers, immigrations and you name people in the uniform right from the entrance of the airport will demanded money. No give, no go and no stamp of your passport and force you to strip off if you say you don’t have money.
We are not to that stage yet, do we?

Better you ask YB from BN to table and pass the resolution to kill all the Dayak in Malaysia, so that all the BN will take all the NCR Right. I am sure this resolution will pass and approved by Parliment as the Dayak anti-BN are few. Does it not enought for you and your BN supporters?
Iban abroad since you are outside the country you know what i am talking about. You can make comparison that we are not so bad right. Maybe some government policies not to our favours but it may taste good to others since we are in multi racial society.

Yes i am Dayak iban and i feel we should appreciate the effort what the BN gomen are persistently doing. This is not old fashion argument and i don’t want us to go backwards as well. Dayak Iban are fighting for their rights, fine as everybody does. Malays have special rights and do you thing every malays are emphasizing this rights and given this rights. If they were there would be no more disgruntle among the malays towards the gomen.Chinese rights as not all chinese are rich as to get scholarship, loans from the banks without mortgage, buy and acquiring land, chinese school also never been granted.Indian rights almost the same as chinese rights also never been granted all. Infact put to jail because too extreme.
There is no perfect gomen on the surface of this earth. There are always opposition no matter how carefull you legislate, weight, evaluate the implementation of certain things. Man thought they are always superior than others.
Demanding too much rights and noboby shall have more rights above the others. Again we may ask why the politician especially from the BN acquire so much wealth. Again the answer is be a politician as politic is power and power is money.
i dont want sarawak to be like Republic Of Congo, Gabon, Nigeria or any other country that has oppresive regime. the rakyat of these countries may be fed by dictators but thats not an excuse to be grateful. i want better leaders that can serve and loyal to the rakyat. not the kind of leaders who want to expect something back in return for their work.
BN may bring us forward, but with less corruption, we ibans can go forward at a better pace. BN will never agree with ibans on many things.thats why i want opposition that represents our voice.

When Malaysia was formed, countries that is similar to Malaysia was Singapore, Taiwan, South Korea ( In Asia ). Where is Malaysia now by comparison to these countries.
We have evidence in making our observation in this blog. Sweeping and blur statements are good for “cakap kosong” in kedai kopi politics. In serious discourse such as these, you must have substance and content. I am afraid some of us try to do otherwise.
BN should have better informed person to participate in these discussion if they are interested to do damage control attributed to poor representative into this discourse. Not emotional being or parrots that need to differentiate from facts to hearsay.
We must do justice to intelligence and when intelligence is not used than the discussion is a waste of an intelligent person time (eg. Maramat Tajak) time.

This issue on NCR Lands keep on coming up for discusion on thei blog. It cropped up not too long ago,I guess in April.
Thanks Dr. for facilitting the discussion. It shows our deep concern among us here. The problem now has reached a level whereby someone needs to talks and something positive abour our NCR lands. The state govenment just cannot afford to misinform the Federal government just like what it did a few dayas ago.

The more I read, the more I am irritated with this idiotic comment. Who is the “perintah”? and whose money is that? Where did the perintah got this money from? Its the taxpayers, which include the petroleum royalty, kampung damun kami – apoo…ka belik amat mensia tu. Empelesik Sungai’s stupidity is still not to that level.

Buddy-you need help.Something is fundamentally infantile about the way you think about government and BN in particular. Here’s a modest commment from me,that may help-take time to ponder it before reacting (seek first to understand).
1. Don’t feel like a traitor if you start to question BN policies when you see injustices with your own eyes e.g: untitled NCR land being declared state land, and to rub salt into the wounds-the BN state govt refuse to allow Dayak to survey and obtain land title. See, Malaysian citizens are required by the Federal Constitution to be loyal to the King only.In fact,if you think about it, patriotic duty to your King and country is to keep the government on their toes.
2.Your statement about perintah somewhere above is typical of many Dayak who have been lulled by paternalistic government…ok for a young country to have paternalistic government but not a country seeking to advance its democracy. This may be obvious, but really – the perintah administer public funds, formulate public policy and set up institutions. They don’t have any supernatural, god-given power to rule over your lives. Perintah is not to be equated with an omnipotent raja of mythology,that cannot be challenged, as I imagine some old fashion Dayak (or some politicians) would have you believe.And even if you have benefit from government institutions,it still does not beholden you to the government to the point of whitewashing any government failings…you have to admit that’s what you do in every comments (whitewash)
Finally,from your postings so far, you are clearly a rabid BN supporter.My friendly challenge to you is to really look inside yourself and see if you can come up with fresh reasoning as to why that’s the case.And post it here.There was a post a few weeks back -”Kenapa saya benci BN”. You can counter that with your personal true story, why you are so enamour of BN.
