1. On 2nd November, my longhouse, Uma Long Bangan Sungai Belaga, had taken some preliminary actions towards Pusaka KTS who has discriminately and secretively allowed their sub -contrator to just bulldoze their way through into our NCR land and our longhouse territory. This contractor has gone beyond what one can imagine. We had already written letter to KTS’ boss in September and cc to so many VIPs including Prime Minister, Opposition Leader (Anwar Ibrahim) and Chief Minister. What has KTS done? As if the world belongs to them alone without even thinking that there are human beings who own that territory.
2. We went to search for the workers who are mainly Indonesians and asked kindly for the 2 chainsaws, 1 axe and 1 ’sandak’. Only by doing this that the manager rushed to meet us and ask for negotiation. what to negoatiate? I find this kind of approach use by these outsiders seem to be very disturbing because their dirty tactic is barbaric. Just wonder when shall our IPs get so united like in the past and fight it together.
3. I was told that some chinese guys were looking for me this morning. I hope it is for good and not to harm. However it is wise to be always on guard. I pray that God will send his angels to protect me daily in serving and helping our IPs in Sarawak. it seems that the battle is just began. I made also a police report this morning.
4. I call for everyone to be united at the same time watchfull on the ground because ‘our enemies are roaming around like roaring lions’ wanting to catch their enemies. Let call upon the power of the Almighty One to protect us. Dont forget our IPs at Long Koyan at this point in time. They are facing the battle right now. we will conduct another NCR Seminar at their longhouse on 20 – 21 November, 2009.
Conclusion
What use is the BN government when its main intention is to deprive us of of land and make us poor. It is a cruel government. It is the government to only support the RICH people. Vote them OUT!

I suggest the affected villagers in the area to seek legal advice, probably to get court injunction to stop the Pusaka KTS to carry out works on the alleged NCR land temporarily.
Pathetic, none of our country leaders look into the plights of the villagers even though they have written letters to them.
What ever it is, the case to be solved peacefully without creating untoward incidents. We do not want to see Ulu Niah tragedy to recur.
My two cents. Baram is worthless to defend. Just support the BN to hit the Sakai who live in the Baram. Just bulldoze the Sakai living there and then build a Surau (as sponsored by KTS). Give the Sakai in Baram the Quran, and then come back after 10 years. I guarantee you won’t find any Sakai there after implementing those measures.
Orang Asal = Orang Sakai = Jakun = Orang Ulu.
I propose new status for the Orang Ulu. We shall call them Orang Panyin. or better Orang Pangkam.
How about that? That way they lose their native rights, and then we can bulldoze their treehouses and make some money off their land. After all Panyin and Pangkam deserve it.
It was only last week, when a group of people from Pusaka KTS led by Datuk Vincent C handing over some token monies so called to fulfilling the native customary adat to Tuai Rumah and a Penghulu Surat. I am not surprised that this week they start to go for the core thing-grabbing of the natives’ lands.
I still can remember what PRPR calls as TrP syndrome in which the companies given the PL just pay a few RM according to the customary laws appeasing the spirits in the native belief.
What we witness today is how this TRP syndrome at work.The govt has indeed made use of the weakness in our community leaders to their advantage, catching the unsuspecting folks by surprise.
Well, whatever it is, the affected people must be united for the sake of our own people.

It’s true MIP. We are a hinderance to the government that tries to develop the State for the good of the governance. The natives are possessive for nothing; knowing that their ‘akis inis’ are the ones who first entered the lands, they try to claim the State land as theirs. Do they pay tax for the land they claim theirs? The State government through its’proxies try to earn as much from developing any idle State lands. Don’t let the land to waste just coz we want to save for the future generation to see.

The land development in Uma Long Bangan was discussed 3 years ago between the Tuai Kampong and the plantation boss, with the main objective to bring the people into the ambience of development and town centres.
As we understood from their discussion with plantation boss, it was the longhouse people invited the plantation boss with the understanding they develop and maintain the road in the area, so that they easily access to the outside world.
T IS JUST A MATTER OF TRADE-IN THEIR NCR LAND FOR THE ROAD. The longhouse people know very well it was impossible for them to get link without the understanding from outside giant helper like the plantation boss. And they know very well Opposition or DB group is talk-cock only, and therefore not invited at that material time.
Before this, the area was connected by the timber company road, which was worn out after they left their operation since 4 years ago.
Off course the government is very concerned with the UMA Bangan people. Our paramount chief who is taking charge ministry of agriculture now is already proposed many small project for the longhouse people, such as providing fertiliser for hill padi free.

The residents of Sungai Belaga therefore is not entitle to erect any building thereon.DL suggest to Yangdikasihi to issue eviction order for the residents of Uma Long Bangan to immediately move out of the land or be charged for illegal occupation/trespassing.

I feel pity and sorrow for the effected residents of Uma Long Baram. But they have to understand in exchanged for the modernisation and development there have to be sacrification on both side.

It strikes me how much the rural longhouse and kampong people have not been informed at all about the status of the land, including the patch of land where their longhouses have stood for ages.
Just because the bulldozers haven’t arrive yet, doesn’t mean the land is safe.To clear the fog, for the benefit of the rural population – the message should be very clear.
I propose the following simple messages and action plan.
If the land has no title, it can be taken any time by the government,or third parties – for whatever reasons, with or without compensation. Since NCR land boundary (Pemakai Menoa) has not been surveyed in spite of the Federal Court ruling,the government – or their proxy, can arbitrarily assign any land as State or NCR land. For this reasons, individual NCR land owners and longhouse folks – is recommended to take the following action:
1. Verify from the detail local map kept by the the Land and Survey that their land area has not been issued to en bloc as part of a Provisional Lease.
2. Those NCR land that has been issued title as agriculture land,to be reverified from the Land and Survey to ensure the record is valid
3. Investigate any surveying activities that may be carried out in the vicinity of as that indicate the start of a master plan for the the area.
4. Have a contact list of NCR land lawyers in Sarawak handy – including their emergency contact numbers, and to determine if the lawyers will do pro bono work, for the poor and underprivilege.
5. Keep in touch with NGOs through their area representative to keep tab on any planned activities to acquire land (and timber resource) in the area.
The NCR Land seminar for longhouse folks mentioned somewhere in Charles Gau article is a good idea. I hope the seminar presentations would be systematic, truthful, and informative – including some of the points I proposed. In line with keeping the message simple – I think the presentation has to start with the premise that all longhouses and kampongs are equally at risk -and what practical, lawful action they can take to minimise their risk exposure.
Its always painful to hear of the plight of the rural Dayak folks in the face of callous, and barbaric oppression.I imagine – it won’t be a walk in the park, to get entangled with big money and deprave, and devoid of any social conscience -corporations such as KTS.The actions of the few to try to face down the forces of evil should be recorded, lest our future descendants forgot about their valiant effort.
Agree with the suggestion in the article, to keep tabs on any report of land grab, and any subsequent update. Perhaps to invite reps of the various NGOs to contribute to the conversation in DayakBaru ? Each grabbing case would serve as valuable lessons on how to improve on the defensive response.

Make your rules and fight to win:
1. KEEP COOL. I know when it comes to NCR issues, it is going to be hot. Try to be cool. Cooperate among yourselves and work out your plans and strategies of overcoming your problems, real or perceived.
2. MINDFUL. There are aggrieved as there are opportunists. Just be mindful of that. Help the real aggrieved and stop the opportunists from making false claims. The more false claims, the more the delay will cause on the real aggrieved solving their problems.
3. FIGHT SMART. Fight for your land and right in an organised way. Have a town team responsible for research on land matters, lobbying, public relation (PR), legal advisers, surveyors, and village teams. Above all, have an “expert” on maps.
4. MEET AND CHALLENGE THE COMPANY. Challenge the key or relevant comapny staff head-on with facts or documents of ownership/usership of land, be it with titles or non-titles. The company mentioned and the L&S have the maps to show whether the lands were yours (ownership/usership)or not. If possible get hold of the maps from your YB, if you don’t have one. The YB must have the maps. He uses them for development purposes and for acquiring state land for his own use. If he says he has not got them, he could be hiding something from you. Don’t give up, pester him to get the maps for you. Fight on facts and proofs. The MAP is your BEST WEAPON.
Remember, the GROUP with better organisation and knowledge plus technology wins, not necessary the rich or the company.
Be confident, be consistent and be cool.

Dear friends,
1. If the rural folks, their YBs and their supporters including the NGOs are serious in helping the State Government and the rural people to solve the land issues, in particulars NCR issues, the problems would have been solved by now.
2. It is better late than never. I therefore, suggest the following:
a. Form a Task Force.
(1). Mission. To solve all land issues in Sarawak within three years.
(2). This task force should be formed and organised at state level, divisional level and district level. It is an organisation for three years and not an ad-hoc organisation. (It is to be organised in the like of the former RASCOM with three main components.)
(3). A CEO, man of integrity, is to be chosen and head the task force. The personnel should include L&S staff, police, army, civil administration, community leaders, adat istiadat staff, NGOs, legal advisers/lawyers.
(4). The terms and references of the task force are to be spelt out clearly. The survey of state land and village boundaries is a priority task.
(5). Enough resources and funds are to be placed under the command of the task force to conduct its activities and complete its mission wihtin three years.
(6) The task force can engage private agencies to help it to complete its mission within the time frame, if its own resources are not enough.
(7). Let the formation of task force be the No. 1 priority of the State in this 5-year Malaysian Plan and the next 5-year Malaysian Plan to ensure what is uncompleted will be completed.
(8). Let all state assemblymen agree that all land issues be solved before the issues grow bigger and harder to solve, especially the NCR issue.
b. The CM shall be the Director of Operations and his deputy, the Minister of Land Development.
With a political will and a task force to conduct the operations with military precision and single-minded, I am absolutely certain, the mission will be accomplished and BN Sarawak will continue to rule, with the people showering love and affection for the Government that cares. 1Sarawak, People First, Performance Now.

Dare to Dream is not Dare to Fight. Is there any way you can bring them together and focus on the subject or topic matter at hand, without going all out at each other throats. It is quite scary to participart in such an “hot atmosphere”.

Grandma Anna, you can’t expect good exchange of words when two parties with different political ideologies meet tho are both Dayak. One party is supporting BN and fully responsible for grabbing of Dayak Iban NCR land whilst the other party is the group calling themselves as DB, protector of NCR lands, against discrmination, suppression and bullies of BN. Centuries back our ancestors also fought and killed each other over control of territories, and the losers were killed and their heads chopped and those not killed were taken as slaves.
So in the case of confrontation btw DB and DL is a matter of life and death and sssssssssso OUTSIDERS better stay away from this confrontation!!!

Appreciate your effort to put this idea together.Seem to have been prepared with due diligence and attention to detail.
It could work !
But in the same breath, I would also urge caution. You sound like an educated, and earnest young man. Do Prepare to be disappointed – gracefully; to remain cool, collected and not become cynical – too fast !
The idea such as yours, or its many variants can easily be drawn up in a minute or two.No disrespect,or condenscension.
Unfortunately, it appears that the state BN government does not consider it a problem at all !Is the NCR land issue a problem for Dayak YBs ? Judge for yourself.
With 200+ and counting, court cases – and some Dayak people have died, because of land confrontation, you would have thought that there would have been sufficient case and merit to set up a representative task force from the Bar Council, Native leaders, Politian,Business, NGOs etc, to address the problem ? !!!
But NO. Hell, Najib himself came and said he had been assured by Taib, there’s no issue with NCR land, remember that one ?
The issue for many Dayak who understand NCR land issues, is that the issue goes far beyond NCR and oil palm development etc.
The issue, simply put is this: how can it be justified and accepted, that the Sarawak BN State Government would not EVEN grant LEGAL ownership to NCR land, including those land on which longhouses have stood since the Brooke era ?
And in so many recorded cases, the powers-that-be, would no hesitate to provide Provisional Lease to big corporations from the city, so they can bring in bulldozers to bulldoze the land, even on peoples meager property such as fruit trees, rubber trees etc ? (There was a case reported in Borneo Post, a few days ago – where the farmer even had a Land Title, and yet the land was bulldozed for oil palm since 2001, and the authorities – including the police was reported to have taken no action)
Many of the majority rural poor who kept silent in the past, and had taken any compensation they can get, were coerced and cheated into the decision. You would have heard it many times, if you care to listen to the ground. “The land had to make way for road infrastructure etc. The oil palm developer will provide jobs, access roads and bridges”. But in many cases, the area would be logged empty first – and the infra would remain a pipe dream. And even where there is access road, it would be designated for “private use”.And I have not begin to list out those peasants who were promised dividends, when it turned out, most dividends were the RM132 per hectare,per year – for the first 10 years – and many did not get any dividend at all, after 8 or more years !
I hope you have not been disheartened. Go see your CM, see if he would give a hood about your proposed Task Force. And oh, it was also reported that the CM had blurted out NEE (Native Estate Exchange) during his speech, and James Masing as the Land Minister, was dumbfounded when asked by reporters about it. That should tells you something, doesn’t it ?
And, no I don’t care to guess who you are. It makes no difference to me, if you are the Chairman of KTS, a newly-installed Dayak minister in Taibs cabinet, son/daughter of Taib, or a Dayak toilet cleaning in the shopping mall. The ideas is more important. Will read and reply to your post, if it remains interesting, helpful and honest as those you have posted so far.

And for your deep thought and consideration as well, we people have been roaming in that area even before 01-01-1958. The survey map fails to see the signs of our great grandparents living in the area as it was taken from the air but not on the ground. So it is not a state land reserved for someone like you,CM and cronies. Our CM grandparents were in Mukah, easing themselves by the riverside and let that yellowish substances floating in the river feeding some ikan belukang. Now, how could theyclaim to have inherited the lands deep in our area?.

Give the information & distribute the rural folks with education and knowledge about the real world. Guide them & ourselves. As i visited the rural areas in sarawak, i feel pity for them, there are really work hard to survived, a huge land they developed by themselve without advanced tecnologies not like others that given by the goverment, mostly there only pay attention to there own religiuos.what about the other race instead? some parties should responsible with this. suggested – For rural folk lands, what has expereinced such in baram rural areas they should have implementing the grant for each of there land. without land title it very hard to protect ourselves unless we are unite againts the goverment project. someone whose the leader need to bring the issues to the parliment.

Sorry if I have annoyed some of you. I tried to throw it a little quiz to lower the heat of argument when some readers were at one another’s throat.
Yes, I know a little of the history of old dayaks’ warfare and chopping of heads. Scary, isn’t it. But please don’t bring back the old horrific memories.
Now, we live in a new world, new Sarawak, 1Sarawak. The fight now is on “land and money”. More on money than on land. Land means money too.
I thought everyone is keen to solve the land issues affecting all Sarawakians and also NCR issues, mainly affecting the dayaks.
I believe, we cannot solve one and ignore the others, although the discussion here is on NCR land issues.
All Sarawakians must settle the land issues as a whole for all Sarawakians. The land issues affect everyone.
I don’t think Dato Henry Lay is evil. I say it, not to defend him. He has done a lot of good to society and has employed many Sarawakians whose lives and families depend on him and his company’s performance. He has given aids and donations to many poor organisations, including longhouse folks.
Give credit where it is due and do not just call him evil without facts. Perhaps, we are jealous of him that he is doing well, very well indeed. He can be shrewd and firm in business, not necessary bad. Meet him, know him and then we will realise he is a human being too, like you and me – a creation of God.
I am no friend, no relative, no employee, no business-associate to Dato Henry, I must add. I am a retired primary school teacher, remember.
Well, if there are two groups, both groups should produce their own solutions for the following reasons:
(1). To help the rural people to make use of their existing NCR lands productively.
(2). To suggest/recommend solutions for the “contested lands “, the land they claim are theirs and the Government say it is state land.
(3). To propose to the government, in particular to Dato Sri James Masing, a suggested task force and measures to solve the NCR issues.
It would be interesting to place the two solutions side by side in this blog and see which one is better and more workable. The readers can judge for themselves and comments can be added to them.
It would be more interesting if Dato Sri James Masing would organise a forum for the groups to present their solutions and a panel of judges to give their observations and comments.
The forum should also be open for participants to make constructive comments and recommendations, in an orderly manner.
On the panel of judges, they must be carefully thought off and only those who are credible and impartial are to be invited. At least, two judges should be outsiders, preferably from the University of Malaya, the best ranked university in Malaysia.

So be rest assured, I am impartial and only giving my opinions and views when I am not playing mahjong. My grand-daughter Nikita is very insisting and she wants me to cut down on mahjong. Yes, it is certainly interesting to see if DS JJM could organise a forum on NCR land issues. I cannot wait to hear some favourable reply form him.

There are a few points I like to put across before I leave my computer to visit a friend.
1. Do not lose hope and confidence. Even the CM and DS JM would listen and might agree to a forum and the establishment of a task force to solve the land issues. Like it or not we need to believe, “People first, Performance now”.
2. The approach should be different. A non-political group should be organised to meet DS JM and present the case.
3. After meeting DS JM and having get his agreement, together the group and DS JM make plan to present the proposal to the CM, with DS JM as the leader. It is his baby, so to speak.
4. Be confident that the CM will lend a willing ear to listen to the proposal. If it is a good plan, he will appreciate it and he would get his AG and Directors of LS and Forest to go through the plan thoroughly and recommend to him the course of actions to be taken.
5. As a CM, he would go for the best plan. Please remember, as far as he is concerned, what he is doing and the government is implementing on is the best for the state and the people.
6. The twin-aims are: A. The Government is happy it can proceed with its policy of development. B. The dayaks are happy their NCR lands are recognised. Both the twin-aims are achieved. that amke Sarawak more conducive for foreign investors and peninsular companies to come in and farther develop the land, thus enriching Sarawak and its people.
7. Even large plantation companies like KTS would be happy and agreeable to the plan.
8. The main pont is the plan must be a better and workable plan, capable of providing a conducive atmosphere for development and with the NCR and other land issues ironed out and settled once and for all.
9. For those two groups preparing the plans, please put on the thinking caps and place themselves in the shoes of the dayaks, the plantation companies and of course the CM/Government.

As I have said, I am not conversant with politics, but I believe we have to ask DS JM or his office to host a forum on finding an acceptable formula to solve the NCR land issues. Ask and you shall be given, Knock and the door shall be opened.
Has anyone tried before knocking at DS JM’s office-door and asking him to host or sponsor a forum.
The approach should be a friendly approach, bearing in mind the aim is to seek for an amicable solution, considering all parties’ interests.
DS JM is a smart and intelligent Minister and he knows how to go about convincing the CM to organise the forum and to establish a task force, fully staffed, equipped and funded to complete a long and belated mission. Even in the late fifties and early sixties the British Government, while still in Sarawak wanted to conduct and complete all surveys of lands in Sarawak, ensuring the village and state boundaries were clearly defined.
Maps, based on air-photos taken in 1958 to 1962, were made and are the documentary proof of the areas cultivated or farmed by the people, I read in the Government annual reports. It was also based on these maps that Land Code 1958 was prepared.
The maps do not lie and must be used as the authoritative documents to determine which are NCR lands and which are state lands.
Without following a proper methodology in defining the boundaries, it is impossible for all parties concerned to agree to which are NCR lands or which are State lands. Do not based on stories which are never accurate or evidence that presented themselves after 1962.
All parties must first agree to the methodology and then go on conducting the surveys. Without the latest technology, it would not be too difficult to carry out the task and complete the mission.
Any experienced surveyor can tell us it is as easy as ABC, given all parties are agreeable and giving their full cooperation.
Now, does it sound far-fetched or is it within the capability of Sarawak and yours – 1Sarawak -”People First, Performance Now”.

PE , CI , jojis & august made attempt to meet Masing but instead they were being chased out.What more DS Masing, even the longhouse folks also do not welcome them. Why do you think the L&S is so quick in mobilizing their machineries and demolishing farm huts and longhouses in LPFs and PLs belonging to Pusaka KTS? These are farm huts belonging to poor farmers for Christ sake. Dato Henry L.au is a vengeful person. He is a racist deep in his heart. Anna, when the Dayaks are at a dead end with nobody willing to solve their problems, we might have no choice but to go back to our feudal ways of dispute resolution. Maybe in a different way. Maybe with sarin gas and tnt.
Very sad to hear our dayak people been bullied by our YB, who use to talk very sweet promise only BN can do the job and has a lot of money. Now what is this all about? So this time the people in Uma Long Bangan Sg. Belaga pls keep your promise not to vote BN again and also may sure your young people must register now to become the voters. I believe BN win all this days because undi hantu and our old days people always believe in BN. Don’t vote for Be End anymore BN is always tipu the rayat.

I’ve been in your shoes before. I have post to this site with several nicknames before and in the the end, I “pen-off”.
HOWEVER, knowing that most of the time, BN are manipulating facts in mass media, etc; arouse my anger and dissappointment.And this is the factor that keep me in this site.
I just can’t give decent responses when responding to people like MJC,DL and their ad hoc committee.
We, the DBs, realized that all discussions in this site falls into the DEAF EARS. But, it doesn’t mean that all EARS are DEAF…!!!!
