BN government trying to do nothing about PKFZ

Taken from The Malaysian Insider

Dayakbaru:

This is what “Corruption” is all about. Because the Back Bencher Dato Seri Tiong is involved they tried to hide it. The BN government never care for the tax payer money that they spent and used in unwise manner. If we do not pay our income tax they will run after us like criminals. When they steal our money – in big sums, they can buy private jet and live in palaces they wanted to keep it quiet.

With that billion given to Sarawak – we could have built more and better roads.

DS Tiong is my MP in Bintulu and very famous for giving money out of his pocket. He is not even a Robin Hood and it seems that in Bintulu we might have voted for someone who is …… I do not know what to call him.

I am sure SPDP will put him up as a candidate and the poor Bintulu voters will be voting him again. Even those educated Dayak will be proud to be associated with such @#x person. Money is not the only measurement of a person success. In this case, it is a disaster to have such leaders.

For Malaysia, BN is another disaster as corruption is bringing the country down. No wonder those migrating out of Malaysia has doubled up.

The OSA has been abused to cover up for BN corrupted practices.

KUALA LUMPUR, Dec 2 —

Official Secret Act

The government lodged a police report recently about leaked Cabinet documents on the on-going Port Klang Free Zone (PKFZ) scandal.

In a written reply to Klang MP Charles Santiago, the home affairs minister stated that the police report was made by the Finance Ministry on Sept 16, 2009, and that the case was still being investigated by the police.

The case has been classified under section 8 of the Official Secrets Act (OSA) where a person can be charged with divulging official government secrets in a wrong manner.

Government will never hesitate to oppress the people but never the guilty one among themselves

“The government will not hesitate to take strict action against any party which leaks out official government secrets either through government agencies or other means, based on the legal provisions at hand.”

A thorough criminal investigation is under way to determine the source of the leaked document, whether it was a techical glitch, carelessness or a “hidden culprit.”

It is the truth and why is the Government in denial?

In lodging a police report, the government is conceding the fact frequently stated by Pakatan Rakyat that the leaked documents are indeed official Cabinet papers on the PKFZ issue.

The government has also announced that it has appointed a special task force led by its Chief Secretary to look into the Auditor-General’s report on the PKFZ.

The leaked Cabinet documents originally surfaced on the online web portal Malaysia Today some months back.

It is a dumb cabinet – impotent despite its power to act

The contents are said to suggest that the Cabinet had been aware of the financial losses faced by PKFZ for some time, and no follow-up action had been taken to remedy the situation

    Dear Dr. John,

To many Malaysians, that is corruption, to some Malaysians that is smart business. Who are right and who are wrong is “hard” to determine, legally.

To the people of Bintulu, his voters, the MP could be a hero, based on the number of terms he was voted in as their sweet MP.

Now who are these people who voted him in as MP in the past 15 years. My simple guest is there are mostly dayaks. Who do we blame now? He is a dayak hero. They love him. He is a sweet MP.

Don’t blame the dayaks in Bintulu too. They could be ignorant. The educated and good dayaks had failed to teach them well enough to understand the money is people money. Perhaps, the majority of them are not contributing their tax-money and cannot feel the pain like you do when the money could be better used to build hospitals and universities for their children and children’s children.

Remember, I said, we only asked what Petronas should have contributed more, we never asked Shell to contribute more. See how our simple minds work. The whites are always right. The Government is always right.

God bless Sarawakians. God bless you for teaching the dayaks to be better informed.

    Thank you.

    Dear Dr. John,

What could be more hurting than the PKFZ case to righteous people like yourself to see the possible case of the money from the oil and gas from Bintulu had been “robbed” by someone from Bintulu, with some of his “helpers”.

The money could have been better used to build roads in Bintulu Iban heart-land and more hospitals, universities and colleges, and modern-schools in the rural areas in Sarawak, besides training more dayaks and providing interest-free loans to be entrepreneurs and businessmen and women. The poor people are the sole losers in the case of PKFZ.

May God bless everyone, the guilty and the ignorant.

    Thank you.

    Dear Dr. John,

What should be done by you to correct the situation to keep the dayaks in the rural areas better informed?

    May I share my view?

Each Friday or Thursday night, you should have compiled the main points you wish to disseminate to the rural people into a summary, so that the educated dayaks going back to their longhouses can bring with them the messages for them to inform their folks at the longhouses.

Your blog can be the main source of information for the good and educated dayaks to bring the news to their longhouses at weekends.

I am sure the good educated dayaks would be looking forward every week for your messages before they start their journey home.

It is like from the president blog, the weekly good news would be disseminated to the rural people.

Perhaps, there are other ways but you should to make it easy for your readers to bring home the messages you want them to impart to the dayaks.

Perhaps, you should encourage your readers to form “informal clubs” at coffee-shops at the various towns they are working and share their ideas and your messages. Get it better organized to be more effective groups so that on weekends they can do a greater service to dayak communities throughout the land.

May God bless you for better-informing the dayaks.

This is framing the debate within the Petroleum Development Act of 1974, in which the oil royalty for the state of Sarawak was set at 5%. The oil royalty is taken from gross profit, before tax and before the pay out according to Production Sharing Contract terms among all the partners.

Its not appropriate to frame the question about oil royalty on how much Petronas or Shell, or any other partners for that matter, should contribute to Sarawak. The more appropriate question is how to modify the Petroleum Development Act 1974, such that oil royalty can be increased either retroactively, from a set time frame – or to be effective from any commencment of Production Sharing contracts – or any renewal/revision thereof. The quantum increase in oil royalty will have to be defined according to a formula, perhaps by the amount of annual budget require to bring Sabah and Sarawak to infrastructure parity (electricity, water, roads, housing, schools, hospitals, industrial parks, bridges) with Malaya within a time frame.

Other options that may have not been considered is to split Petronas up into 4 independent regulatory and operating agencies – Sarawak, Sabah, Malaya, Overseas – such that Petronas Sarawak would oversee Sarawak operations and would report directly to the Sarawak ADUNs. Let Sarawak oil money be directly under the control of Sarawak. Of course, some ignorant ADUNs would be wondering where the money is going to come from, for the state to partner any MNC in oil and gas business, as Petronas does. The moment the restructuring is completed, I have no doubt Sarawak can raise sufficient sovereign funds for financing the state oil and gas business through the proposed Petronas Sarawak.

On PKFZ and OSA : strange that just as ISA is supposedly being reviewed (to shorten the detention without trial period), OSA “rose to the occasion” to retard baby step reforms – when people should instead demand for the Freedom of Information Act. OSA – it seems, can be used to hide unsavory government business, just as its close namesake ISA, is being used to suppress human rights.

    Dear Dr. John,

I must advice the battle you are going to wage against corruption will be a frustrating one but one you must not give up.

Try to get the MPs and State Assemblymen from Sarawak to join you in the crusade against corruption. So far, I heard very little from the MPs talking about combating the No. 1 ENEMY of MALAYSIA, corruption.

Perhaps, the dayak MPs can help you to start the ball-rolling.

Get the newspapers to requesting the MPs to state their stand, not comment, on the various cases of corruption.

Or get them to state in general term their stand against corruption and what are the strategies recommended by them as protectors of the peoples’ monies.

Hopefully, the reporters and journalists will do their part to help protect the peoples’ monies and to help in developing the people, especially the dayaks, through the reduction of corruption and saving the monies to develop the Country and the State and its people.

I observe in the newspapers, there are many reporters and jounalists from Malaya daring to report than our own reporters and journalists from Sarawak. Perhaps, MACC Sarawak is not so active or there are less corruption cases in Sarawak. Anyway, the reporters and journalists can keep on highlighting cases of corruption in Malaysia and giving their views.

Good luck in your fight against corruption.

    …………………………………..

    DB Readers,

This is a dangerous comment to put the problem to DB or SDGA or Dayak educated or any third party shoulder.

It is totally gomen responsibility to solve the people problem. What ever problems and what ever race or religion. That is is the fact. Whether can accept or not.

We should put in this way, the main point we have to form the gomen is to solve the people problem, protects the people, at the same time give progress to people and the country.

If there is any corruption, injustise, misinformation and any other odd administration of the our gomen/leader or suspected event highlight in multi media publicly, it is gomen responsibility to investigate, correct it properly first thro his agency.

The third party like NGO, SDNU, SDGA and DB are only assist. If the gomen/leader/gomen agency fail to do so that means the gomen/leader/agency is failed to bring justice to our people and should be blame even change them.

Here is the responsibility of our people including DB, to highlight, critize, blamming and give approciated solution to the gomen/leader/gomen agency who are fail to do their job.

Pls do not afraid to highlight, critize, blaming and give solution of the wrong policy, bad gomen and corrupted leader. It is our duty eventho hard for our leader to swallow.

Secondly, do not turn the corruption act to legal act by twisthing the fact, even though you tell me, who said I am corrupted if I good support from Sirat Mentality Voters to be their YB by buying their vote with my corrupted money.

Corruption is corruption. Whether we can put him to jail or not is another matter.

One day, if all the problem blame to third party first, all the people will see all the gomen agency like police, anti-corruption, civil court and so on will nothing to do just look and see the corruption around them at the same time blaming the third party for being unaffective.

Let say, the gomen form the mafia and wrapp people wealth even killing them like Chin Dynasty time in China, do we still ask DB to take action? I hope in this modern world it won’t in this way.

Remember, the gomen agencies are being paid by people money thro people tax while the third party used their own pocket to serve the people.

This is the system of our gomen we shall have.

Pls do not turn the story opposite way.

Dear Dr. John and Mr. Meramat Tajak,

In relation to the topic on PKFZ, I am talking on the tax-payer monies that could be saved and better used for the people of Sarawak.

On Shell and Petronas, besides the 5% agreement, it is on what we should have asked the Seven-Sisters Oil Giants to give more to Sarawak on social community grounds, like building universities and hospitals/clinics for the people of Sarawak, not as free gifts but for the two companies to own, finance and manage the institutions for the benefits of the people, especially the dayak children.

The changing of the Oil Act should be treated separately.

I believe, the change will take a long time and I fear it may not be done before the oil and gas run out.

Shell has been in Sarawak for about 99 years and Petronas has been here for about 35 years, can they not help build universities and hospitals/clinics, especially in the divisions of Miri and Bintulu as a goodwill after drilling oil in this region for years and making much profits and developing their companies so much through the gains on Sarawak oil and gas? The gains made by Shell over the years could be more than Petronas and Petronas could be more than all the big timber companies put together. Correct me, if I am wrong. The idea is not to discuss how much they make but can they contribute MORE, on humantarian grounds?

I am sure the two Big Sisters companies would consider if there are requests from the MPs and State Assemblymen as a Group. Or when they (two companies)leave this region they would realise they have not contributed much to the society of Sarawak and did not leave anything worthy of remembrance. Perhaps, it is too late to ask Shell now, as I heard she is down-sizing her organisation in Sarawak, possibly to support her other organisations overseas. Ask, We Must.

God bless our leaders, even if they had failed Sarawak in asking for more.

    Dear Dr. John,

In relation to the responsibility of dissemination of information, in particular the government policies, to the rural people, rest untirely with the government. I know that.

What I was talking about is the information discussed in your blog. Some of these information are real important and useful to be disseminated to the rural people to make them better informed and aware on what is going on in Malaysia and how these happenings and events are affecting their lives and the future of their children and children’s children.

Besides, the rural people should be better educated to be more politically matured and make wise decision on voting, comes election.

It is your privilege and honour to help them in the best way you can through this blog of yours and your loyal readers and comment-contributors, on and above, what the government is doing.

God bless you and your blog.

most of the points that the equaliser has written really give some positive impact toward the dayak.

it is from which dimension you see/preceive it is the real question

some times his ideas are provocative, constructive, narrative, challenging one minds, other time look frustated, very often are INSTRUCTIVEs but most are neutral.

and it goes well with his mysteries named, the equaliser, well to equalised the situation when thing going tough.

hence he is needed, keep on writing equaliser since we recently acquired 4 sets of Marshall, Pervay,Gibson Speakers for the purposed of announcing what is wrong and what is right to the dayak.

SARAWAK MACC DETAINED 7 INDIVIDUALS, SYNDICATE BEHIND SYPHONING 60 PERCENT FUNDS.

    Wednesday, 02 December 2009
    (Eastern Times)Wednesday, 02 December 2009 –

The Malaysian Anti-Corruption Commission (MACC) Sarawak Branch has uncovered a syndicate, comprising high-ranking government officials and a company director, responsible for siphoning federal funds amounting to millions of ringgit.

State MACC Director Samsiah Abu Bakar said that, so far, MACC had detained seven individuals, comprising government servants, contractors and middlemen who had been linked to the syndicate, under Section 18 of the MACC Act, 2009.

She said the suspects, who operated as a group, had been active in Kuching and the ‘mole’ had access to a list of Federal projects. However, Samsiah said all the suspects had been released on bail pending completion of investigations before being charged in court.
She said the syndicate, which had a strong network in other districts, had also fabricated claims for a housing project in Santubong.

“Our investigation revealed that the syndicate is also active in other districts such as Samarahan, Sri Aman, Betong, Sibu, Mukah, Bintulu, Miri, Limbang, Sarikei and Kapit,” Samsiah told the media at her office here yesterday.

She revealed that MACC would pick up more suspects linked to the syndicate soon, including those involved in ‘Ali Baba’ businesses.

The seven suspects had been linked to the misappropriation of project funds for mosques, suraus, football fields, community halls and clinics.

Samsiah revealed that since 2005, MACC Sarawak had received 637 complaints related to false claims, and 295 complaints have been investigated, with 22 cases brought to court.

She added that MACC would investigate the syndicate’s link with other districts soon to prevent it from misappropriating more funds. She appealed to Bumiputera contractors whose names had been misused by certain people to come forward and report to MACC.

Commenting on a report by a national daily, she said it was inaccurate as her findings involved only four cases from 2002 to 2005, and not all State and Federal projects.

On her findings for the four cases, only 40% of the allocated funds reached the target group while remaining 60% were diverted elsewhere.

Samsiah said she welcomed the State government’s initiative to set up its own internal audit to check and monitor project implementation.
