MACC need to correct itself first

By resigning do Datuk Ahmad really believed that he is absorb from all the MACC wrong doing during his watch? If he thinks he does he would need to correct the working of his brain. Malaysian suffer so much under such an inapt MACC leader in Datak Ahmad.

The new MACC chief being a career officer would most likely not make much changes to MACC. Malaysia will go down the drain as such officer are indoctrinated with Ketuanan Melayu politics.

Ketuanan Melayu politics has managed to destroy everything that Malaysia rely upon to succeed. Should this political agenda continues the brain drain would accelerate further as it has now double-up.

Where would 1Malaysia People First Performance now stand. Najib spent too much money into 1 Malaysia and it is not bring development to Malaysia.

Spend the money on rural infra-structure and improve the physical comfort of rural school would be a much desired program compared to much noise and no ground substance for 1 Malaysia.

DEC 4 — While most Malaysians would be happy to see the back of Malaysian Anti-Corruption Commission (MACC) chief Datuk Seri Ahmad Said Hamdan, his departure will not be the panacea for the many ills of the national anti-graft body.

MACC was biased in most of their action

Ahmad Said was previously the director-general of the Anti-Corruption Agency (ACA) which turned into the MACC last Jan 1, keeping its staff while wielding more powers to fight graft that has been pervasive and pushed Malaysia down the ladder in the Transparency International Corruption Perception Index.

The key pillar of reform is still not making positive impact

Next Jan 1, Ahmad Said will be on five months leave before his official retirement, closing a controversial chapter of his career and the disastrous start to MACC, which was touted as a key pillar of reforms initiated by Tun Abdullah Ahmad Badawi after the historic electoral losses in Election 2008.

But his voluntary resignation won’t change the nature of MACC.

MACC under the Executive  is flawed

The anti-graft body’s problems and bias appear to be institutionalised from years of being just an agency under the Prime Minister’s Department and now still a commission under the Executive rather than reporting to the Parliament.

UMNO corrupted politician given Off the hook

One just hast to look at the manner the MACC has given ruling party politicians like Datuk Seri Khir Toyo and Khairy Jamaluddin a free ride despite the Umno disciplinary board warning them about ‘money politics’, the party’s euphemism for corruption. Khir’s Balinese-styled mansion in Shah Alam remains fodder in the grapevine but not a case in their files.

The Court was needed to correct MACC action

The Teoh Beng Hock inquest has also revealed how the MACC treats its witnesses until it was slapped with a court ruling that restricted it to interviewing witnesses to only during office hours. The commission might sulk and pout or sarcastically claim the fight against corruption is hampered but Teoh’s death is a marker to over-eager interrogation.

MACC in Perak now look pretty childish in their work

And its venture to trap errant politicians in the Perak case is still unfolding in the court case against two former PKR executive councillors. One would think the MACC would fight graft, not tempt or lure officials and politicians to commit the offence.

MACC has no regards for law in their work – and only catch small fish

The years under the executive have made the formerly ACA and currently MACC officials arrogant and belligerent in their tasks that they have no regard for the law or what they define as corruption. In this quest, their dragnet has only netted the small fries, not the big fish that continue to infest Malaysia.

Ahmad Said’s replacement, his deputy Datuk Abu Kassim Mohamed, is a career officer and is not expected to make the MACC a dynamic and respected anti-graft body that runs without fear or favour.

MACC  is bringing  BN down

That task lies with the Prime Minister. And if Datuk Seri Najib Razak wants to win the next general elections convincingly on his “1 Malaysia. People First. Performance Now” concept, he will have to ensure the MACC is not a paper tiger or the Umno’s cats paw as described by veteran opposition leader Lim Kit Siang.

Najib will have to change MACC for the better, not just its bosses.

Too much empty slogans

Or else his concept will be a joke, like “Bersih, Cekap, Amanah” slogan of Tun Dr Mahathir Mohamad and “Cemerlang, Gemilang, Terbilang” slogan Abdullah had used. Ahmad Said and the MACC are proof that these slogans never translated to anything concrete. And hope is dim it will get any better.

    From ACA to MACC is just like changing shirt.By changing your shirt people would recognised and identify you,it doesnt make any SIGNIFICANT IMPACT at all.

    To say that MACC is truely an Independent Body is NONSENSE.The MACC can only Investigate and upon investigations completed,they have to refer and report to AG.

    Without consent from AG,they(MACC) cant prosecute…The Prosecution Power lies in the hand of AG.They(MACC) have no Prosecution Power,they only can investigate and it is up to AG to decide wether to proceed the case and prosecute or just TUTUP CERITA.

    Like it or not,there wont be TRUTH and JUSTICE until there is a REAL Separation Of Powers in the Judiciary,Legislative and Executive

    Yeap! Most government agencies are required to refer their criminal cases to AG or a DPP, who are their legal advisers. This is required by laws and some are required by administrative procedures. Some criminal cases need sanctions to prosecute from AG or DPP as required by laws. Whether AG or DPP is biased in making a decision is another question. You cannot assume or speculate.

    With the establishment of the five different bodies under the new Act namely, the Advisory Board, Special Committee, the Corruption Consultation and Prevention, the Complaints Committee, and Operation Review Panels, I think MACC are more transparent and accountable not only to the government but also to the public.

    The 42 commission appointees comprise retired judges and civil servants, academics and researchers, the media fraternity, lawyers, parliamentarians from both sides of the political divide, and NGOs.

    However, a prosecution for an offence in the MACC Act shall not be institute except by or with the consent of the Public Prosecutor, thus MACC may be beholden to the Attorney General. This may lead to the perception of the public that MACC is not 100 per cent independent, but their actions can be questioned the panels if they are biased.

    On top of that, we hope MACC are professional in doing their jobs to improve their corruption and eradicate corruption seriously.

    I think the main weakness remains Part VII, Article 58 which vested the powers to prosecute solely on the Public Prosecuter (Attorney General) – as you have said.

    But note that as well, that Part III, Article 13 -15, regarding Anti-corruption Advisory Board,Special Committe on Corruption,and Complaints Committer, indicated these committees has no role in the decision to prosecute. The boards and committees are only dealing with smooth resourse allocation, planning and general administration of MACC – and mostly report to the PM.

    Further, Part III – did not make special provision for the members appointment to be vetted through Parliment, and did not spell out explicitly for the members to include representatives of civil society – Opposition, NGOs,Bar Council, Private Sector etc.The Advisory Board and Special Committees are appointed by the Agong, no doubt – on the “recommendation of the Prime Minister”.So this MACC remains wholly accountable to the Executive, which in itself, can be an intractable conflict of interest when persons under investigation are members of the administration. The supposed independence of the MACC can still be sabbotage directly or indirectly via withholding of fundings especially if the investigative activities of MACC threaten the image of the administration.

    I think for MACC to earn its credibility, it would need to strive for greater transparency, in deeds more than slogan. For a start, it has to publish for public scrutiny all cases that have been submitted to the Attorney General, but was not prosecuted. This way, the public can judge for themselves the quality and impartiality of MACC investigation, and the basis of the decision of the Attorney General chambers when it refuse to prosecute any case, on what ever ground.

    I would like to say that MACC is nothing more and nothing less than a TOOLS for UMNO led Barisan Kurang Rasional to remain in POWER.

    Whatever one may say in Legal Perspective or whatsoever,it has been proven that MACC only goes for IKAN BILIS than a SHARK.

    Hundreds of CORRUPTION CASES has been lodged but where is the ACTION???When it involved Big Guy,the case will slowly faded away from the eyes and ears of the Public..
