Is it leal to destroy other people houses
From a long house upbringing, it has always being drummed upon us not to destroy or abuse things and properties that belong to others. It is really an offence that attract the elders to impose “fine” on the offender. We have specific “adat” to address such action.
First: Is our Dayak ADAT applicable in this case.
Second: Does it gives the “land developer” the rights to destroy the houses without consultation.
Third: Does it gives the Land & Survey the right to destoy any body long house / houses when the owners are seeking court decision?
Fourth: What is the police doing – are they involved in a “legal action: or are they part of the “illegal” team by default.
Summary
I have laid the basis of our action to make a police.
Now we need Dayakbaru to take up this action.

The govt create the laws for its’ own benefit and right to demolish any home as long as it is within the laws. To the govt, it is right to demolish any home of the native people who occupy the land that it thinks is its land, even without slaughtering a swine. It’s really up to Awg Middle to do so. He is the governance of the law whether the rayat like it or not.
Native adat seems useless for the case of Rh Noh. The law of Awg Middle is above all.
Making a police report? I can’t help but laugh out loud! Thats the problem with dayaks. They just don’t get it. Either slow or just being plain ‘lakia”stupid? If the executives don’t respect the law courts do you think the police could care less? The police are thugs in uniform working for both the government departments and the “towkay”. They see nothing and do nothing because of “belanja”. What we would like to know is, who gave the order to demolish the longhouse? That person owes the rakyat an explanation on this heavy handed eviction order! For a human being to make another “homeless” is beyond humanity.
By the way I think the native adat has died a natural death beginning with the first illegal occupation of our NCR lands. Enough is enough. Dayaks are down trodden for too long. For justice to prevail dayaks might as well resort to the law of the jungle just like their brethren in Kalimantan when they confronted the maduras to protect their lands.

time does change everything. knowing the Dayak Adat is a good thing.
but the PaneL Land Code superceded the Dayak Adat. and the Government of the day choose to apply the Panel Land Code in regard to tr. nor case.
though i feel pity and sympathy for them, but that it, once you broke the law, you will pay a heavy price for it.
the good thing arise in this case, tr. nor’case is a lesson and experience we learn, that it don’t mess up with the law and the government.
Believe me if a police report is lodged, the police will treat the report either NFA (No further action) or NOD (No offence disclosed). In other words the police will not open an investigation paper into this case. It is better to proceed with civil case if there is a basis.
However, no body can stop you to make a police report. May be you can buy a copy of the police report to be used for civil case.

i think there is no need for a police report, just a waste of resources and time. unless ones, want to full his filing, to show he is doing his work, otherwise useless.

1. I expected PR come out with good idea as they plan to champion the justice in Malaysia including discrimination agianst Dayak.
2. As a Dayak indepent union, I expected President of SDNU come out with President of Dayak Adat Istiadat condemn such action and use their power to enforce their regulation at least including Penti Pemali Orang Iban. Iban Adat, it is totally Mali to excavated others longhouse. In Iban Adat, Civil law and international Law give a right for Rh. Nor fight back, kill the excavation group to protect their property being destroyed in front of them and protect them self at their home.
3. I am not expected something from BN and Dayaklama, as they are the culpit on this case. If they do something, be aware, Ada Udang di sebalik batu. They may do some help but it is just for the purpose of their politic.
Action:
1. First, compile the report in term of video, picture, comment and sent to internet or other means to attract attention from the international media/body. DB can invite international media for interview such as BMF, Reader Digest and so on.
2. Seek legal advice, make a report to police, seek a penti pemali from Dayak Adat Istiadat and last bring to court. Taib Police may reject our report and Taib gomen reject our justice in their Court is not important. We shall know Taib law and policy toward Dayak. We may lost the court case now, reject by police on our report, but our generation never forget how the Father of Discrimination and Dayaklama threat the Dayak. This is important point for the record and information of our next generation so that they know how the Taib threat the Iban.
3. Last, give warning to all Dayak and say that all your house are illegal as not even one has a land title if base on Taib Regulation. Taib gomen with Dayaklama has every right to demolish it at any time in term of development. Be prepared for the next case.
4. In the election, I am not very confident of Dayak vote at the moment as so many Sirat Mentality still around with Dayaklama. We may let it to PR.
5. But I am confident that, international body will help Dayak until the justice is prevail if Dayak fight back in the spot with whatever means even in term of bebunuh against the Taib gomen excavated their longhouse. Do not keep quite do something.

The YB concern should assess the situation, if necessary then lodge a proper report to the relevant authority. Why act half-heartedly by procrastinating the issue. Justice will determine it course! We are all in sympathy with TR Nor and his `anakbiaks` for the loss of their longhouse. We condemn the demolition of their longhouse if it was an act of a criminal.
But in this case, the Land and Survey Department was executing a court order and the police presence was maintaining of the peace and security so that no untoward incident occurred. These two government`s agencies were exercising their basic functions and responsibilities.

Is it legal to demolish their home?
Yes, at least in the context of the laws that has been set by them.
So, don’t make any police report coz it’s legal to destroy or demolish their home.
They are doing the ‘halal’ work of demolition coz the laws permit their action.
It’s sure/really legal for the L & S staff to demolish their home. The verdict favors the L & S. It’s also legal for the Ibans in the L & S to involve in the demolition. The laws permitted it.
