You’re nothing if you’re landless

As Native, we can’t blame anyone if we all end up landless and be forced to seek in the littering urban areas as ‘Bangsa Orang Setinggan Sarawak’ (BOSS) and/or ‘slump dog’.  We still have time to acknowledge our “Native Rights”. If we failed to plan, we plan to fail.

Ignorance of the law is no excuse and inaction in the face of encroachments onto our land is the sure path to landlessness. We may have many NGOs but how effective and active are these organization today?

We need to Change our think to ‘rethinking model’; what, why, where and how we have gone wrong, and find what possibilities and opportunities beyond all these?

Time won’t wait for us and soon you will be gone. You or we all need to serve well and finish well for the sake of our next generation. If we have seen mistakes in our history then we must find the solutions to correct that mistakes.

Is “Land Reform” initiative necessary or must?

About 60,000 natives or more would soon be displaced by the multi-billions Mega Dam submerge projects and the ‘Green gold’ or palm oil, that poses an even more insidious threat because it promises prosperity and development to the numerous poor of Borneo along with immense rewards for the ‘BN elite conglomerates’.

Land Reform Process should focused on three (3) major areas: Restitution, Land Tenure Reform and Land Redistribution. Restitution, where the government compensates (monetary) individuals and/or native landowners who had been forcefully removed and/or displaced, has been very unsuccessful and the policy has now shifted to redistribution with secure land tenure. Land Tenure Reform is a system of recognizing people’s right and/or native customary land rights to own land and therefore control of the land.

Redistribution is the most important component of land reform in Sarawak and Sabah too. Initially, land was bought from its owners (willing seller) by the government (willing buyer) and/or from GLCs (federal or state owned companies such as Pelita, Salcra, etc) direct or indirectly or as trustee (legal or illegal means) acting as ‘willing seller’ by the private investor (willing buyer) and redistributed, in order to maintain public confidence in the land market.

BN-Malay Supremacy tyrannical and bureaucracy

The Malaysian bureaucracy is familiar not only to the local but the world with one associated with inefficiency, laziness, poor service, abuse of power, double standard practice, racism, one sided media, deniable religious extremism and corruption.

It is one that is part and parcel of the hidden racially charged context of our institutions and it smacks of the ideology of Malay dominance or even Malay supremacy (Umno Jagoh Rakyat) that the civil service has come to personify.

This is the dark side that is generally kept away from public scrutiny and accountability, not only because it runs against the grain of what a modern, progressive and representative civil service is, but also because it is regarded as politically incorrect to discuss or analyze it.

Dayak Vs Malay Supremacy – Understand your ‘Native Rights’

Now, I would like to ask DB/DL here again; (lets think, refresh our mind and ask yourself)

  • Where is our Native Court now? How effective has this court protect and defend our native sovereignty rights?
  • What is the function of our Native Court? Do we have Dayak Native Chief Judge, Native Attorney General and our own court administrators running this court?
  • If we are equal to the Malay via ‘bumiputra’ status; is our Native Court not equal to Syariah Court as stated in the Federal Constitution 1957?
  • How legal and official has the Federal Constitution 1957 (not 1963) recognized our 18/20-points Sarawak/Sabah Agreement? Are these two documents not an official treaty?
  • Malay Reserve Land Enactments protect and guarantee the Malay land right; do Dayak have any NCR Land Right Act and/or Native Act?
  • What is the function of Majlis Adat Istiadat of Sarawak (Council For Preservation of Customs and Traditions)? How best has this organization help us and the Dayak NGOs?
  • If the Orang Asli have their own ‘Orang Asli Affairs Department (JHEOA) Hospital’; why can’t we have one?
  • If the Chinese and the Indian have their ‘Sekolah Bantuan’; why can’t we have one?
  • If the Malay have their ‘College’; why can we have one?
  • Is adat also means ‘custom’, ‘customary law’ and ‘native law’? Any different between adat Melayu and adat Dayak? Is this justice and equality?
  • Are Dayak not ‘bumiputra’ who have the same special privileges like the Malay?
  • Is Malay native or ‘bumiputra’ or ethnic or Malayan Muslim race?
  • Is Dayak native or ‘bumiputra’ or ‘pribumi’ or ‘dan lain-lain’ (others)?
  • Is Orang Asli native or ‘bumiputra’ or ‘first people’ or aborigine?
  • NCR Land Acquisitions; please define the different between ‘public property’ and ‘privatization’ and/or ‘private property’ or ‘proprietary property’?

‘Outsiders’ controlling the Dayak

How far have our own Dayak leaders, political parties, NGOs or Majlis Adat Istiadat or Native Court or we “DB/DL” here ready, willing and able to put-up a consensus initiative to demand for an increased representation at both the executive level and the management level in all the government agencies including GLCs formed to handle Native Dayak affairs?

We need to find a decision now in favorable to our needs, racial discrimination and the marginalization of Dayak voices in important policies that affect our livelihoods and next generation. I just hope this will be the new beginning of Change WE Must.

This is not the first time that such concerns have been raised. During the past 47 years we have had a constant stream of written petitions, memoranda, press statements, expert reports and academic work that have drawn attention to the way in which the government has violated the basic “Native Rights” of the Dayak and analyzed how the Dayak leaders, Native Court, Majlis Adat Istiadat, Ministry of Rural and Regional Development, Ministry of Sport and Culture and other associated government agencies have been the main instruments for control, divide-subdivided, historical injustice, oppression and repression of this community.

In response, the Government has simply ignored them or opted for delaying tactics. We have enough of the so called the BN “proper channels” to air their grievances.

Herein, let me list you some practical tips to hold on to your NCR land

Five (5) steps must be taken to ensure that NCR claims are not eroded by the passage of time, encroachments and inaction on the part of native landowners:

  1. ‘Surat Bantahan’ (Letter of Protest) to the Land Office in the case of encroachment by parties who don’t have a NCR claim to the land in question.
  2. Ask the Land Office officially in writing, as per the proper format; for a ‘siasatan awam’ (public inquiry).
  3. Get the Land Office to acknowledge receipt of every written communication with them.
  4. Make three (3) attempts, at three (3) months intervals, to have a public inquiry held and, in the event of repeated failure, approach the courts.
  5. As a last resort approach the courts –  Assemble your witnesses, get your evidences/exhibits (photos and the relevant documents including historical evidences, GPS mapping, geologist report if any, etc), legally assemble your NGOs, legally assemble other affected groups who have the same problem like you and appoint your lawyer(s); ‘Saman dan Tuntut’ (ST).

NOTES:

  • Files and documents can go missing and Land Office staff may be on the take from others who are after your land. This has been proven in many cases in the past.
  • The Land Office can and may ignore requests for a public inquiry owing to ignorance, apathy, pressure from people after NCR land or because of its reliance on the Land Ordinance only.
  • In Sarawak, the Majlis Adat Istiadat is a body which is established by law to codify native customs and under the Native Customs (Declaration) Ordinance, 1996, codes of native customs may be compiled and published by the Majlis Adat Istiadat after consultation with the Chiefs and Headmen of the various native communities and with the approval of the State Cabinet. Under that Ordinance, any code of native customs published would be conclusive as to the customs of any native race and shall not be questioned in any Court who would have to recognize and enforce the same.   • ‘Bumiputera’ or ‘Bumiputra’ is a Malay term widely used in Malaysia, embracing indigenous people of the Malay Archipelago. The term comes from the Sanskrit word bhumiputra, which can be translated literally as “son of earth”. The concept of a bumiputra ethnic group in Malaysia was coined by activist Tunku Abdul Rahman. It recognized the “special position” of the Malays provided in the Federal Constitution of Malaysia, in particular Article 153. But, the constitution does not use the term “bumiputra”; it defines only “Malay” and “aborigine” (Article 160(2)), “natives” of Sarawak [161A(6)(a)], and “natives” of Sabah [Article 161A(6)(b)]. Definitions of ‘bumiputra’ in public use vary among different institutions, organizations, and government departments and agencies.
  • You have the right to make an official Police Report if someone (including the enforcement bodies) has trespassed your ‘private property’, ‘NCR Land’ (also known as Native Communal Proprietary Land) and/or have damaged your property and assets/plants in your land including injustice and/or misappropriation of documents without your physical authorization. In the Federal Constitution, Article 13 provides that no person may be deprived of property save in accordance with law.
  • Your constitutional right as citizen: No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
  • Systematic Land Alienation also means a strategic government policy (mostly promoted by interested political party) to eliminate your historical facts and entity. When you have no land, you have lost your origins and indigenous rights including your heritage.

Conclusion

Don’t end up losing your land to become refugees in your own native land. Remember, you are also entitled to compensation under the existing law.

As native you have the rights to defend and the right to control, manage, develop, protect, conserve, and sustainably use other areas of economic, ceremonial and aesthetic value in accordance with your indigenous knowledge systems and practices (IKSPs) and customary laws and traditions, and to equitably benefit from the fruits thereof.

Right to Benefits; As native, you have the right to benefit from the ‘abi-besi’ – utilization, extraction, use and development of lands and natural resources within our ancestral lands/domains and to be compensated for any social and/or environmental costs of such activities. Under the existing law if your air, land and water is polluted and/or others, you have the ‘rights’ to seek legal compensation and demand lawful justice.

    Good writing. It will be better if plus with “ACTION SPEAK LOUDER THAN WORDS”.

    We DB should go to the ground, contribute some effort to convey the message (rights) to the target and ignorant groups.

    If we think others are not doing enough, GO to the ground and add in our effort to contribute if not to make it so called “enough”.

    If every one of us go to our own “constituency” or the very least our own long house, I am optimistic there will be CHANGE that we aim for.

    Anang lembau bechara ngelaban sida ke ngambi tanah NCR enggau adat ke baru ditempa kemari wai. Atur James Seberok enggau baka anak buah iya Charles Berok, Vyner Berok nya endang nadai salah ditanka kitai kena kitai ngetan ke tanah NCR kitai. Ukai nya nyenyamai sida niang aki ini kitai ngulihka tanah nya menya. Sida aki nyau tepaksa berambun ke seput alu bisi pala sida nya kena pumpong maya ngetau ba umai berebutka tanah nya enggau kaban kitai.

    PERKASA which is headed Dr Dr. Ibrahim Ali defends Malay rights which he claims has been eroded. There is NEVER an erosion of Malay right except that this race practises multiple standard among themselves and upon other races/religion.It is an NGO and just been given permit to publish/spread its propaganda through its bulletin/newspaper.
    The difference between PERKASA and SDNU/SDGA are while Malay rights are intact under the Malaysian Constitution,but PERKASA is using the so-called ‘scare tactics’ to regain support of all Malays.Malays are synonym with the governance of Malaysia because Malays has been there at the helm, but why PERKASA? What actually do they want?

    For the latter,they are doing what they are doing because Dayaks right has indeed been eroded esp.on NCR lands.The present BN gomen could not do much to help Dayaks. So ,what choice do we have?

    So, Telaga Kumang,your support for PERKASA shows that you indeed support KETUANAN MELAYU at the demise of Dayaks.

    1. We don’t take away others’ rights
    2. We don’t prevent others from taking and enjoying their rights.

    4. We just want lawful justice returned to the Dayaks – as much as justice is enjoyed by other Bumiputera groups ie Malays, in this country.

    Nya alai Aki-ini, ibu-aya, bala menyadi, ba penemu aku manah amat polisi perintah PR ke deka megai menoa kitai. Enda nyalah-nyalah baka polisi UMNO enggau BN ke bukai maia sida ke agi nyadi penyakal numbang ka perintah British munya.

    Diatu angka dikumbai BN pembangkang PR tang jemah ila maia sida megai perintah nya baru kitai nemu BN ke amat pebangkang, membangkang polisi enggau pengawa orang ke manah ngemansang ke menoa enggau bansa.

    Pia mega, ari kitai nyukong PR kitai oleh nitih ka pemansang demokrasi menoa maju baka Amerika enggau Jipun ke ngaga dua iti parti pemerintah ke selalu beganti-ganti megai menoa iyanya enda nyalah-nyalah baka BN enggau PR menoa kitai.” Ko Telajan ngurai ka polisi pembangkang mendua mit.

    SDGA is still gaining momentum….I see no politcal motive behind SDGA. I myself was present during the last AGM….so dont hearsay only. Get the right picture…
    Enrol yrself as members if y’re a graduate.

    That is one of the platform to generate our struggles for Education and the rights of the Dayak majority in Sarawak….keep moving SDGA under Dr. Dusit….We are behind you!!!

    You can have many resolutions,10 may be and start distributing the DB article to rural voter…but one have to take own rest.

    It was done before in Batang Ai prior to the by-election. Remember a group of DB were not only not welcomed but being chased out. You can try your luck again, no harm, but chance you can expect a more hostile rural voters esp. longhouse folks.

    IOI SCRAP JOINT-VENTURE WITH PELITA

    IOI Corp, Malaysia’s second-biggest publicly traded palm oil producer, said it scrapped a joint venture agreement with Pelita Holdings Sdn Bhd to acquire and develop 7,000 hectares of land in Sarawak state into oil palm estates. – Bloomberg, Jan 12, 2010

    Exhibit 1(b):

    The proposed joint venture (JV) between plantation giant IOI Corp Bhd and Pelita Holdings Sdn Bhd will not go ahead as planned, IOI announced on Bursa Malaysia yesterday.

    The JV, which was announced in August 2008, would have seen IOI Corp and Pelita Holdings form a new company, IOI Pelita Kanowit Sdn Bhd, to develop about 7,000ha of land in Sibu, Sarawak into oil palm estates.

    IOI Pelita was subsequently incorporated on Nov 12, 2008, with IOI Corp and Pelita Holdings holding one RM1 share each.

    IOI Corp said the JV agreement was terminated by mutual consent, and IOI’s share in IOI Pelita would be sold to Pelita Holdings.

    IOI Bhd gave up?
    Gkm2020 – it’s pure keuntunganlah. After your posting I was thinking aloud – why IOI withdrew huh?

    1. My friend from plantation sector said: IOI Bhd is making 19% profits from its plantation in Sabah. Whoa, that is better than ASB.

    2. If they make 19% – then it occur to me; Out of 19%, it would have to give 30% of that untung to the longhouse people; right or not? Say just for easy calculation, IOI makes 20% from Plantation. If that 20% is RM20, the money it makes goes to their own pocket.

    3. But if they combine with my longhouse folks, they have to give RM6 away (30%). Surely they don’t want. Correct or not? Accountants, pelase help.

    Which makes you think, will our longhouse folk ever get anything from all the plantation JVs?

    (I salute IOI Bhd for their honesty – they are not willing to be part of the con-JV. Thanks, IOI Bhd).

    Case tu ketegal company balak ke ka ngambi kayu ba pulau galau di Ulu Awas.

    Sida serumah diarie ke 2iko lawyer ari rumah panjai Awas empu ianya Lawyer Kilat Beriak enggau Lawyer Chambai Lindong(SDNU). Nyadi lawyer tu nadai dibayar, tang meh unkus ke kena nurun niki ngagai court cukup maioh.

    Enti nitih ke padah sida serumah semua duit fund JKKK rumah panjai sida nyau abis lalu ditambah ke enggau duit turu sida serumah.Kayu ba kampong abis ditebang laban ke bukti pulau nya enggi sida ba court.

    Nama nuan enda anchi-anchi Chak, tang penemu nuan mimit nadai meh ngelai ke Kumang Chak!!!! Enti bisi kelai Kumang entu nuan nolong, nyukong bansa Iban Chak. Pelaba aku pendiau nuan tu aja Iban, kelimpah arinya nuan tu ‘Yes Sir’, pak turut, Pak Kaduk & Mat Jenin.

    Ingat Chak kitai Iban Dayak nyadi ulun ba menoa diri empu, ketegal Iban ke baka kita.

    BN NEW NCR LAND DEVELOPMENT CONCEPT IS A BOGUS DEVELOPMENT SCHEME!!! IT JUST A ‘CONCEPT’???

    ***SKIM KONSEP NCR BARU NIPU, NGUPAS, NGELENGIH SERETA NGERAMPAS TANAH ADAT DAYAK/RAYAT ENGGAU MUPUS KA ASAL USUL PENATAI BANSA DAYAK!!!

    NOTES: This is a systematic and modern way of new “KETUANAN COLONIALIZATION” (also referred to as PENJAJAHAN), and the Land Code is used to indirectly eliminate/erase Dayak entity and/or erase the historical facts of Dayak including submerging their heritage longhouse sites and burial grounds, via systematic ethnic cleansing policy so the future Dayak generation would ultimately lost their “Native Rights” (indigenous rights).

    WE must learn from our history how the “KINGDOM OF ULU AI” (herein referred to as the ‘Dayak Kingdom’ in the 16th Century) had lost its historical evidences/facts!!!!! Later these Dayaks became ‘ulung’ to some of the Malay Sultans!!!!!

    Today Iban/Dayak are ‘ulung’ too as their only employed as “workforce” and/or “Bansa Orang Setinggan Sarawak” or “Underpaid Kuli”.

    IF IT IS A GOOD, EQUITABLE AND PROFITABLE SCHEME THEN IT SHOULD BE “WIN-WIN AND WIN”!!!!

    We really need to educate our people on the rights that we are entitled to. The amendment of Land code should be stopped because it’s tantamount to abuses and exploitation and in favour of those ‘towkays’ employed by the BN to chase the Dayak from their NCR land. Look at Sime Darby, Tabung Haji, LCDA, FELCRA, SALCRA etc… They have tons of money to buy our rights…The YBs’ just nod their head…
    We need to resolve this outstanding issues among dayaks…organise a mass seminar, Mass Dialogue, Mass Forum, Mass Demonstration to highlight our predicarment….

    Paramount chief…where are u???, hiding under your bed…waiting for the corrupt money from these daylight land Robbers!!!

    Enti udah bc sawit, nadai meh sida company tabung haji ulih nanam sawit dia. Kitai ga bc kaki jari kena ngereja tanah diri empu.

    Tang ka bendar, maioh kitai Iban bejako aja, seekar tanah semina ditanam ka buah sepun dua. kati ko nya deh?? Reti nya kitai udah meri peluang ngagai company ngemaju ka tanah kitai.
    Ko jako nadai duit/modal kena ngemaju ka tanah. Bah kitai tau beduruk, bulan tu tanah apai wai kitai tebas kena sawit, bulan dudi apai endo mega. Baka kitai ka beduruk nunggal. Nadai salah nya deh.

    To talk about land issue is too big gamble for DB. Let leave it to the expert lawmaker of the BN. To change land laws is the prerogative rights of the gomen of the day and this gomen no other than the BN. There is no alternative to this BN gomen. To govern the country and to steer the country policies lies on the shoulder of the gomen. The mandate already given by the rayat to the ministers in the gomen to do what they wish to. We must obedient and follow what the leaders said, just like any organisation we must be a loyal follower. If the leader say jump to the river, everybody must jump. No question should be asked and so when it concerning the land amendment we just follow the directive given.

    To know whether gomen made a correct or wrong move, the voters will decide on the polling day. After the election is over everybody should be loyal to the present elected gomen and can only voice your dissatisfaction through ballot box in the next election.

    If Tinting Tinjau magazine you DB cannot materialise it, why still talk about bigger issue like the land.
