LCDA is the native trustee and has clear fiduciary duty to protect the rights of natives
This means that, when native customary landowners surrender their rights to the LCDA as trustees, there is a clear fiduciary duty to protect the rights of the vulnerable right holders. A government agency that takes on the duties of a trustee under a commercial arrangement becomes a ‘trustees twice over’ (Finn 1992: 243), particularly where the vulnerable landowners depend on it to negotiate the best terms on their behalf (Lehane 1985: 98).
JVC model is contractual relationship
In the present JVC model, the relationship between the corporate developer and government agency (trustee) is contractual. Does a fiduciary relationship exist between them? It is suggested that the mutual confidence between the JVC and the LCDA (or its agents), in appropriate circumstances, does not exclude the possibility of a fiduciary relationship.
The Malaysian Federal Court has already held that the relationship between parties in a joint venture agreement is a fiduciary relationship. Thus, if a right is not sustainable in breach of contract, there may be an avenue in equity where there is a breach of the fiduciary obligation.
Breach of Trust and Remedies of Beneficiaries
What remedies are available to beneficiaries should there be any unauthorised act or in case of a breach?
At the core of the trust concept is also a right of the beneficiaries to make the trustees accountable to the trust and to ensure that they act within the terms of the trust deed. The remedy for the breach of a fiduciary duty includes declaration of rights or a claim in damages and compensation.
Beneficiaries have “policing” right
Beneficiaries have a right to have the trust property invested in a way that will keep a balance between them. They have a ‘policing’ right, to see the trust accounts from time to time, and to require the trustees to make good any breach of trust. While trustees are not bound to give reasons in exercising their discretion, the absence of reasons could create a presumptive case that a trustee’s discretion has been miscarried or was not exercised upon real, sound and genuine consideration. Beneficiaries may also apply for an injunction to restrain a fiduciary from acting in a way that is detrimental to the trust.
The issue takes on a different angle where the trustee is a government agency.
Section 29(1) and (2) of the Government Proceedings Ordinance 1956 debars an injunction being granted against a government or an officer of the state. An order for the preservation of property may be made if the plaintiff can show that irreparable damage not compensatable by damages would be caused. Despite the nomenclature, if the effect is the same as that of an injunction, it will not be granted. Thus, while it is open for claimants to take legal action to prove their claims, very few natives have the means to sustain such actions.
Questions of Proof and Reversion of Land
A fundamental aspect of the JVC is that native customary ‘owners’ become joint venture partners without having to provide financial capital. This means that ‘their equity in the joint ventures would be based on the area of their land; and the irresistible part of it all is that their land would be returned to them when the government has no more use for it’ (Jitab with Ritchie 1991: 66).
To what extent can the beneficiaries be assured of the reversion of the Native Customary Land? The issue is not that ‘the government will not cheat its own people’; rather, the problem lies in the discharging of the onerous burden of proof that is on the claimant.
Problems for successors after expiration of 60 years agreement
Since Native Customary Lands are not individually surveyed, there are latent uncertainties in terms of the specific shares in the land. At the expiration of 60 years, persons who have surrendered their rights may no longer be alive. This could cause problems for the successors unless they can work out a clear system of partition and inheritance of the land. If the native claimants are not able to settle their claims among themselves, there is a possibility and danger of them losing their rights to the legal owner who has a registered (master) title to the land.
The registration of NCR does not provide indefeasibility of title – it is just acknowledgement of a claim
The new Section 7A of the Land Code provides for registration of Native Customary Land but does not provide indefeasibility of title. In Fong’s words, it is treated merely as an acknowledgement of a claim to the land until the contrary is proved, a certification to a right, and not a ‘proprietary right in land’. The onus of proving an interest remains on a native claimant.The problem reverts to the question of the restrictive provisions under Section 5 and the clash between statute and native concepts of land.
Native have to proof that the land belong to them
The commonly deployed method of determining the existence of native customary rights over a parcel of land is aerial photographs taken prior to 1 January 1958. However, these may not be available, and the claimant then has to show alternative physical evidence of occupation before 1958, or else show records of permits, which are virtually non-existent.
Thus, upon amalgamation of all the contiguous lands by the Director of Lands and Surveys, land that is vested in the trustee becomes the legal property of the agency with no compensation paid to the claimant. With no payment of compensation at the point of amalgamation, is the amalgamation tantamount to summary taking of land without compensation?
We must survey the land before joining the JV scheme
One possible way to avoid this problem may be to survey the land and grant individual titles to the owners at the point of their joining the scheme. This would ensure that persons who join the scheme know their specific share and are able to stake a claim at the expiration of the 60-year provisional lease period. Before such a survey can be carried out, such rights must be fully investigated, demarcated and recorded before titles can be issued to replace the customary tenure (Goh 1969: 4).
It has been argued that a full-scale statewide registration of native interests over land would be a time-consuming, tedious and costly operation (Fong 2000). However, in specific projects such as this, the advantages of a proper survey being done prior to implementation cannot be understated.
It is imperative that the authorities take steps to survey the land for the natives.
A prior grant of title to claimants would best serve the interest of the vulnerable owners and the sense of security would be an incentive for participation. It would go a long way in improving the implementation of Native Customary Land development (Songan and Sindang 2000: 251). With the passing of the Land Surveyors Ordinance 2002, the combined effect of Sections 20 and 23 entail that a person who is not a licensed surveyor cannot make, authorise or sign any cadastral map. Since map making by the communities themselves could be an offence, it is imperative that the authorities take steps to survey the land for the natives.
Concluding Remarks
The caution in commercial joint ventures is that, all too often, when there is no more money in the venture, it is easy for parties to forget their contractual obligations and the vulnerable parties often suffer. As an active sponsor of these schemes, it is all the more pertinent for the government to provide some kind of a guarantee that Native Customary Land will revert to the owners at the end of the venture. Similarly, in the event that a JVC withdraws without completing its job, is there some form of a guarantee the native customary owners will be adequately compensated?
Arguably the government’s fiduciary obligation may be said to go beyond a mere commercial arrangement to become ‘trustees twice over’, based as it is on the customary owners’ trust and confidence in the government. Perhaps there is scope here for application of Lord Browne-Wilkinson’s (1995) caution ‘that equity principles must follow developments in commercial law for commercial expediency, but such application has to be both thoughtful and sensitive’. What has been developed as an instrument to defeat unconscionable conduct should not ironically become the very instrument that defeats the rights of those that it purports to protect

I always admired Ass. Prof Ramy Bulan for her good articles appeared during these few days in this blog. But a bit too academic , perhaps she never come back to her kampung in Bareo Swk after she got married during her second year law student UM in 1978.
Since Ramy Bulan article is appeared several times here it is timely to introduce who she is to my fellow blogger here.
As a student, she always a head girl in SMK Marudi and Tanjong Lobang.
Upon passed her HSC in 1977 she was offered to study Bachelor of Art in UM, though she always wanted to be a lawyer. Her HSC result was not that good enough to qualify her to get into the Law faculty. However, she appealed to UM registrar, and she got it when she reasoned that her community Kelabit needs a lawyer to link the people and the BN govt. But it surprises me that she had changed now, for the reason is best known to herself.
It is indeed pity since her marriage to the Baie in Semanjung, she settled there and forget her kampung people.
She should fly to Bareo now, to witness their people suffer during the prolonged dry season where the crops are withered to rot and the buffalo are hunger to death.

We are equally surprised that you, as a P/S, are that ignorant to the way people in Sarawak have changed their thinking towards the policies of systematic grabbing of NCR lands. In fact, all right thinking Dayaks should have changed their mentality and perception to see the losses of NCR lands from their hands to the cronies of the politicians. Only those Dayak recalcitrants will continue to decide supporting the unfair policies of the government,claiming that they are quite fair to the Dayak Ibans. And you are in this category of people,Telaga Kumang.
There reason for her change is clear. And similarly, the reason for our fight is also clear.We jusr cannot become a link to the government when it endlessly keeps on exploiting, marginalising, victimising and sidelining the Dayak. The treatment of the Dayak was bad in the 1980, 1990s and getting worst in 2000s. Thus, it is hardly surprised to see that Dayaks, having used to be a link, now start to destroy this link. WHy must we uphold the policies which are hugely unfair to its own people?
Her articles are never meaningless to the Bario people. Only someone like you will say that they are useless as they are telling the truth about the state government land policies. And these truths hurt you. If the state government policies are fair, then why are there over 100 land dispute cases still pending against the state government?
On the other hand, it is your comments that are useless. You are here just for the sake of neutralising us.You come with your writing because you are paid to do this. It is your means of living.
We know that your comments are nothing other than being used to neutralise DB cooment which are factually correct. You just cannot afford to deny truths which are getting clearer and more difficult for you to deny by the day.
Regardless of what you people say, DBs still continue to do the simplest task in highlighting the unfair policies to the Dayaks and how the selected few cronies have accumulated incredible amount of wealth, courtesy of the Dayak people.
You should not be worried. We will fight till the Native rights are duly observed. Believe me, there is still hope for things are gonna change for the better one day.

Whether joint-ventures to develop their NCR land benefit the landowners or not? To find the truth, go and ask the landowners who have been taking parts in JV.
We should appreciate what Assoc.Prof RB is contributing here. Not in material forms but to the mind. Endu Telaga@Dino@Deo@Arah,aren’t you using technology to log on to this blog, with pictures, etc.One can use facebooks, emails, twitters and whatnots to communicate these days and sharing information. Do you really need to be in the place to know what is happening?
By the way, what has Bareo got to be proud of? Perhaps Bareo people should demand equal pricing policy for pricing for their basic amenities.

There were times when we feel frustrated, angered at what happened to us Dayaks, as mentioned. Just like ‘kacang lupakan kulit’ What can DB do on this matter. Its against our will, our conscience, our destiny.
Maybe you should remind and teach her [Prof. Ramy] a lesson on patriotism…if you are qualified to do so. I think it should be alright with his marriage life…but, she might have to rethink for his position as Dayaks, where our people really need their help.

I can understand why this article bugs Telaga Kumang so much that the messenger was attacked instead of the message. The message brings home 2 key truths (devastating to TK points of view) – that:-
1. There is serious risk that any untitled NCR land used as equity in a JV involving a government agency,will later require “onerous” (very difficult) procedure to revert ownership to the owner after 60 years. The legal derivation sounds complicated, but I think, it boils down to this aspect:

To my mind, this mean 2 things:
A) The law interpret that Dayak who entered into a JV agreement, involving the government agency and private company,is only submitting claims of ownership to the NCR land — and the burden of proof to claim of ownership shall remain all the way until the expiry of the JV. Contrary to what some Dayak leaders have said, the land title is not guaranteed to be given to the NCR land owner -neither does participation in the JV provides any additional legal evidence for claims to ownership (on the contrary, many typical body of evidence of individual land boundary would be irreversible lost from the plantation activity …as Dr Bulan had intimated it as well)
B) If the readers have unfortunately surrender their NCR land for JV development, they should take steps to document the land boundary among the participant themselves, without waiting for the JV company to pay 3rd party surveyors (typically they can give all kinds of execuses). The document can be prepared as a sworn affidavit,to be witnessed by the present local native leaderships – TR,Penghulu, Pemancha.This is not the same as a land title, but to my mind – its better to have something to support the so-called JC Fong’s “claim to ownership”.
2. The status of the government agency as trustee in the JV also beg many unanswered questions and the discourse on it merely ended on a “hope” that

A) Since, if anybody recall – the government does not want to guarantee minimum returns (to the Dayak shareholder) for the JV, and since the government still place the onus on the NCR land owners to provide proof of ownership beyond mere claims be the rightful owner – the government had not exibit …

Therefore there does not exist any evidence of fiduciary duty … since the trustee can’t be held accountable, and taken to court for breach of trust – to comply with the trust deed.
This mean the very claim of Trustee-ship is called to question. The article deftly maneouver to avoid mentioning it – but thats the conclusion, based on the prevailing law. Frankly, its an eye-opener, that LCDA cannot be sued to be accountable, even if the JV goes broke, and have to offload the land asset to a nominated management agent (without paying anything to the NCR land owners)
B) Given the evidence in Point 1) and Point 2A, I seriously think our gullible Dayak folks may be taken for a ride, in both the legal and economic sense. A misplaced trust in the government had occured – when there was no legal foundation for the Trust. The power of attorney had been given to the Trust,without any trust deed – or demand for fiduciary relationship ! It means, in the worst case scenario, 60 years from now, when the legislature ADUN would be populated by a handful of Dayak representative only (why not, after SCORE – don’t tell me the rural electoral features will remain predominantly Dayak),lawyers for the NCR land owners would argued in vain, to reclaim the land for their Dayak clients. Sad.
And incidentally, today in BP – RISDA express interest to plant rubber in the 1 million odd hectare of NCR land.Does it not bother you, that the NCR land owners were never mentioned or factored into the conversation between the government, and corporations from West Malaysia ?
Most importantly: does it not make you think that the individual Dayak NCR land owner should be given land title – URGENTLY, since the vulchers are already circling, and sooner or later – will be going in for the kill. I hope Telaga Kumang does not represent the vulchers …or even BN for that matter.

Firstly, the best line of attack to deal with a narcissist is to recognize your own narcissistic tendencies.
When your own feelings of self-worth are dependent on what others think or feel about you, you make yourself vulnerable to any narcissist’s trap.
Secondly, try to have a safe haven, a place to avoid the abuse, and retain control of your own person and your own life.
Thirdly, get as far away from them as you can. Hardcore narcissists are sometimes unbearable to deal with. Sometimes you just have to walk away.

Dayakbaru – Meramat Tajak has written a very good piece of article of his understanding on the JVC model using “trust” as an instrument.
The English used might be difficult to understand by some of us.Can anybody translate that into Iban for people in the long house to understand.
Sebedau involve JV, any iban must make sure the land involved must be totally his even after 60 years tenure has expire. NCR without any proper document could disappear from the original owner even before the JV expires. Title is the only way to have the rightful owner to the land. Any other document is invalid and may not be able to help one to claim back his land after expiry date of JV. It’s better that the land must have a proper record in the L & S rather than being kept in the JV company file. Or otherwise, don’t involve inthe JV at sll.

My Personal Words of Legal Advice: “SKIM MUNOH RAYAT”
Firstly, if you’re a landowner and not yet a partnership of the “SKIM MUNOH RAYAT”, please kindly avoid getting involved in such scheme.
Secondly, if you’re a landowner and you’re already in the “SKIM MUNOH RAYAT”, as stakeholders you’re advice to review all your legal and trust deed agreement with your lawyer(s). Take necessary legal steps if there’s any known “Criminal Legal-Deed Discreprency ” or “Criminal Breach of Trust” and/or “Criminal Breach of Contract” and “Breach of Promise”.
Thirdly, the evidences/exhibits on the ‘SKIM MUNOH RAYAT” are clear today that there’s no guarantee on which the ‘individual landownership’ would be legally returned to the landowners after the JV 60 years leasehold had expired.
Fourthly, the ‘unit trust’ do not offer a fixed rate of return, it fluctuate, and the return on your investment is not guaranteed (kindly read the terms and conditions in your unit trust form/agreement).
Fifthly, if you’re forced and/or threatened to sign and/or someone has false/forge your signature/signatory or any form of discrepancy or abuse of power without your will/formal authorization then you’re advice to lodge a police report and seek a legal opinion from a reputable lawyer to pursue on your case.
Sixthly, if for any reason you’re conned or duped and/or misled by others (YBs, Tuai Rumahs, Penghulus, Councillors, Pemanchas and others) to join the “SKIM MUNOH RAYAT”, you’re advice to lodge a police report and seek a legal advise from a reputable lawyer to pursue on your case. This may includes some witnesses and other relevant evidences to back-up your legal case.
Seventhly, if you’re promised and/or asked to sign a legal document(s) – please kindly read it thoroughly first (takes 2-3 days or more to study it) and/or refer it to your lawyer to study and evaluate every sentence or clause stated in the said documents which must be an advantage and/or in favor of you. You’re nothing if you’re landless!
Eighthly, if you’re signing an agreement and/or contract please make sure you have a witness, it must be sealed and legally notarized. Blank contract/agreement ie without a seal/notarize is only a piece of blank ‘toilet’ papers.
Ninthly, others may include the followings;
a) We have to sign contract(s)/agreement(s) when we are making some purchase(s) and/or partnership or Joint-Venture or others, such as, buying a car, a house or leasing a land/property or whatever is legal engage. It is very important to read the fine prints or you may give away your rights. Just like your vote right!
b) Before you sign a contract, make sure that you take some time to read it carefully. Put your glasses on, or use a magnifying glass, to see the fine prints, if necessary. Once you sign it, you are entered into a binding legal agreement. Any oversight and/or overlook might cost you a ‘big be-by-gone’ my friend. Any contract and/or agreement is a very serious legal matter (anang main-main); trust no one but yourself and also to think of your next generation, not just today!
c) Make sure the contract states the cost and/or date of delivery or payment or any other that is necessary to insert in the contract/agreement which you might think of your advantage/favor/benefit.
d) Certificates of deposit (CD) and/or Unit Trust Share Certificate (UTSC) and/or Leasehold JV 60 Years Certificate (JVC): Whenever you open a CD/UTSC/JVC, let the bank and/or your legal advisor or nominated accountant and others as it deem necessary and fit know that the CD/UTSC/JVC ‘should not be rolled over’ without your official consent and/or approval. Many banks and/or institutions or private party automatically roll over a CD/UTSC/JVC even if the interest rate has dropped. When you’re involved in a JV or any business for that matter, you need to know the legal aspects and risk factors!
e) Do not sign up for a JV partnership when you’re on the loosing end; your YBs are good politico actors (Remember this words: “I couldn’t recall…”, “Did I say it…?”, “You misconstrue my word….”. and so on) unless they can personally guarantee and/or legally guarantee you.
f) Make sure that the contract/agreement offers you the right to cancel the JV partnership (exit clause where there is a breach of contract or default or any known breach of legal contract/agreement) or discrepancy or abuse of power, and receive a refund and/or necessary legal damage claims.
g) Do not sign a “demand agreement” and/or “unconditional agreement” or “transferable agreement” and/or “transferable deed of trust” or “assignable agreement/trust”. In this kind of agreement can order you to lose your asset or land/property and/or other benefits at any time.
h) Strike out clauses that allow a partnership to terminate your rights and/or benefits or your advantage. It must be of mutual understanding, win-win and benefit or no deal!
i) Before Signing a Promissory Note or Deed of Trust, kindly read both documents, including the pre-printed portions or drafts. You might ask the closer to send you a ‘blank format’ deed of trust and promissory note beforehand. Because preparers are human made and can always make mistakes or typo mistakes, here are the important items to review:
• Spelling of trustee/partnership/trustors’ names and any other names; including it legal status/address
• Principal and objectives of contract/agreement
• Interest rate (and the rider, if adjustable)
• Related amount and/or payment amount, and any others if any
• Prepayment penalties or other penalty clause, if any
• Address of NCR Land/asset/property including date, time, photos, maps and other relevant evidences, if any
Basic info: What is a Deed of Trust?
If you have never read a ‘deed of trust’, you might have questions about it. After all, it is the security for your collateral or loan or others in relation to the JVC. It is the document that is recorded in the public records.
A deed of trust contains three (3) or more parties: (in this NCR Leasing Scenario)
• The Trustor, which is you, the landowner/asset holder/stakeholder.
• The Trustee, which is an entity that holds “bare or legal” title eg. Pelita Holding Bhd or others as specify in the agreement
• The Grantor, which is the State Government (ie if such project/JV is promoted and/or guarantee by the State Government or otherwise the YB concerned)
• The Beneficiary, which is also you – the landowner/asset holder
• Others as it deemed fit and necessary in JV Agreement
The deed of trust is an instrument that identifies the following:
• Original unit trust and/or investment amount
• Legal description of the land/property being used as security for the “JV mortgage” or others
• The parties
• Inception and maturity date
• Provisions of the mortgage and requirements or others
• Late fees and/or other fees
• Legal procedures
• Others as it deemed fit and necessary

Well. Good luck in your strategies to counter DB in this coming SE. I am impressed by some of the things DL group would like to employ to woo the folks’ votes. They are nothing new to us. They are so familiar. You people have been winning because the Ibans still subcribe to BN ideologies ingrained in the mind.
However, DBs strongly believe that the BN ideologies preached by Dayaklama group will be weakened in due course as more and more Ibans could comprehensively understand our reasons for the fight.
We hope that there is light at the end of the tunnel. WIth God’s grace, the time will definitely come when every Iban family manages to have one or two of its siblings who could obtain reasonably good education to see what’s going with the Iban community.
In fact, there have been cases whereby children of the TRs ,Penghulus, Councillors, Pemanchas and so forth have obtained tertiary education, coming back to the longhouse persuading them to review their blind loyalty towards the BN government.
The children of these leaders have seen the tyranny of the government towards the Ibans, especially those living in the longhouse.
The children of these leaders also apparently have some influences over their family members, resulting in the TRs to withhold their eagerness to rally a support behind any BN candidates.
Perhaps we could safely say that the younger generations of our Iban leaders have had enough of the BN’s endless marginalisation of their own people. They now dare to say that there are numerous misdeeds of the government led by YDK to traumatise their concsience.

It will not stop within the family of these TRs only. The folks in the longhouse look agreeable with the children. And that’s not all as their relatives are also going against the continued killing of the Ibans.
Hence, DL, do you still want to force these TRs to support the BN or don’t you think they prefer to listen to their own children?
Whenever possible, DBs must also join in the JKKK. We need to work from within this JKKK to stop the like of Dayaklama.
We are sure that DBs, esp if you are a son of a TR, can influence their own family members and relatives to re-evaluate the reasons for voting the BN. We can also approach the children of other Iban leaders in the government to counter Dayaklama accusations.
Hopefully, by working within the families of our Iban leaders, we will nullify DL’s efforts.
We shall fight for our rights as nobody else will be doing it for us. Our YBs prefer to be silent and rather hopeless. Please do not be scared of their tactics as the Ibans have never been dead for voting against the goverment.

If like this when we can start plant the palm tree? Everybody have their own ideas how to optimize the land so that it will give a good return to the natives. BN formula is straight forward and just want these lands generate economy for the natives and at the same time will increase the GDP.
What is needed is to convince the developer to come with money, and the natives to surrender their land and everything inside it for bulldozers to start with the ground works. If the palm tress bear fruits and after deduction on operating cost the money will be divided according to the proportion in the agreement. This is the agreement.Simple why need a professor and doctorate degree to outline what need to be done.
Upon expiry of land tenure in 60 years and if natives choose not to continue with the planting of palm trees, they can breed cow on his land. The cows can graze on the pasture of this huge land. The population is double by this time and the demand for cow’s meat is increasing and so why worry.
For those who opt and have the mean to turn this land into sport stadium can also do so. Now the education ministry is making sport compulsory in school and by this time we can produce a world class athletes. There are always sports competition going on all over the places. The land owner can also be made rich through sales of ticket.
Don’t make it so complicated DB’s and what is most important the works on the NCR must started and we cannot afford to continue talking on the planning and stuck at the planning stage years after years.
If you think your formula is not workable, well why not turn to the gomen and seeking advise.

Unggal GKM already have something that he submitted to the international body on one subject that we discussed here earlier on. Why bother to plant OP that requires so large an area? The crop is very very very labor and machinery intensive! I think the objective of such OP JV is nothing else but to take NCR to a slowly dying ownership. And it would be the same for the rubber planting that is going to be introduced by RISDA in to the State. The RISDA target the NCR but in similar approach as the OP JV. What objective behind the stone it has to do so? Why seems to be not sincere? The RISDA can provide anak getah to the farmer; the tapper sell rubber; therefore the govt too can benefit as well. In the same way, the OP smallholders sell their OP and the MPOB/govt can also benefit as well.
I think, their target is you know lah!!
Enti nupi ngot, it would only take a 30m x 30m space as compared with almost an acres to plant an OP.
What about nupi ikan keli? It would only take about 2m x 2m for 100 ikan keli. It’s doesn’t require big space.
If one raise a china doll, it only need a single bed bedroom to keep her – one shot RM200. Just imagine if she entertains at least 10 customers per day.
So, the moral of the story….be careful with large scheme that involve JV; it’s better to go for the small scheme, like the sice of a china dolls scheme.

Don’t get flustered…. You do have some balanced postings, where I would silently agree with some of them, and where I don’t agree – I would still understand the thinking behind it.
This is not your best posting… but I did had a good laugh at it, and that’s probably quite the opposite of what you intended …
I had the same perception as yours, Dayak Lama.
Model:
a. Intake outside fund & Technology,
b. Use local land and labour.
c. Give 30% dividends to locals.
I used to discuss this with officials from Pelita. No one had other dissenting ideas on the total maximisation of land use. There were times I had to discuss this late into the night with some Dayak ministers.
But we had no idea about other aspects of Sarawak – ie the frequent land reforms in the legislative council. Just an example:
1. While LCDA is the trustee on behalf of the government and the land owner, what assurance is that trust deeds unchanged within the next 60 years? Did you not realise that that the word Dayak at one time, was almost obliterated from the dictionary?
2. You must also be sure that the descendants of Dayak D can transfer valid wills to his children in future.
I am not trying to split hairs here, but the focus of this Dayak Baru all the while is that Dayak state representatives are very reluctant to speak on behalf of the land owners.
If the legislative council propose laws, as it has all these while, that neglect the interest of the Dayaks – what assurance do we have that greed and their personal positions don’t take precedence over Dayak interests?
After 60 years, as you said, the Dayak can rear cows – this is a fallacy. If they can rear cows after 60 years, why are they not rearing cows now? The answer is simple: it is illegal.
All agriculture projects have to be approved by the SPA (aka CM). To rear more than 50 pigs is against the state law.
To legalise it, you need the Vet Department and EI report – both require proof the land is yours. Showing proof is none other than a valid land title.
10 years ago I tried to venture into various agriculture activities in the state. We met various huddles – and each can only be met if “Jumpa menteri kita.” That answer made me vomited. Rasuah at every corner, so sapa chakap ta’da rausah?
Let me say, NO DAYAK would protest and go to court if the JVs are on sincere, honest and fair terms. Don’t you insult our intelligence. Here I want answers:
1. How much are the longhouse people paid while they work there? Does it meet the minimum wage rate imposed by WTO?
Does it meet the Plantation Union Agreement with the Federal Government? In some plantation that I know, some people are paid RM13 a day – and that alone is enough to suggest exploitation of the locals.
2. Is there any minimum safety precaution for workers that handle weedicides and pesticides? Is there any SOCSO paid?
3. EI report that seems stringent for people like me – is the same standard being applied to these plantations? Don’t you see our rivers are depleted of fishes?
These are beyond politics; nothing to do with BN or PR. These are issues affecting my Dayak people, my own kinsmen. BN has rule for 47 years, now if they have been fair – what stupid people want to criticise and write in blogs like this?
As I said, Sarawak Opposition is the creation of Sarawak inefficient and corrupted BN. Dayak nationalism is the result of pathetic Dayak ADUNs and MPs – Ming Court is the clearest proof. If we don’t speak for the Dayaks, who else?

If for any matter there’s some typo or mixed Malay in it, I believe it’s better than nothing. Don’t blame no one, I/we can blame the BN for not providing us our own “SEKOLAH RENDAH/MENENGAH/KOLEJ BANTUAN DAYAK”.
Why the Chinese and Indian communities can have theirs and why NOT us!!!!! Maybe East Malaysia is not West Malaysia or Dayaks are always regard as “Others” or bangsa “Dan Lain-Lain” and/or “others” could also means “aliens” (from another planet) – that’s disgrace and total racial discrimination!! Or intended ethnic classification strategy to erase our identity and entity and/or our “Native Rights”!!!

Your effort has made a world of good in our Nttempt to disseminate the misdeeds of the BN government in Sarawak, particularly the plights of the Ibans as a whole.
DBs must work along this line as Dayaklama and group have really made use of the weakness in our TR-to-decide-for-all kind of administrative work in the longhouse.This sort of decision making is not fair the younger generation of the anembiak.

It’s obvious that DL and his teams (MJC/TK/C4540/arah) have failed and lost their politico BN rhetoric propaganda campaign model to gain and/or regain the mindset of our DB members into their platform.

THE RULE OF JUSTICE
If you promote the rule of injustice, you take away their liberty and rights, including your own and your next generation rights.
The rule of law is not enough if justice is not respected, prejudice, bias and double standard. When a party promote injustice onto their own hands they are master of injustice.
Justice is a concept which has been argued about by philosophers since the beginning of history. A Just nation or government would have a nice balance between the governing class, the management class, and the working class.
Each would be treated fairly for the betterment of the overall society not Just the ‘special few’ and/or ‘special people’ or ‘privilege people’. Similarly, a Just man would harmoniously balance the conflicting desires within himself/herself/themselves so that he/she/they is a fair, good, and happy man.
The concept of justice has always been intimately tied to the idea of fairness, and it has always been associated with the idea of rationality.
Everyone wants to live in a society which is fair. When a case goes before the Supreme Court/ Court of Appeal, the judges (or justices) are expected to rationally deliberate long and hard about the fairest course of action. It’s wrong for judges to be prejudiced.
They pronounce a guilty person innocent and/or denying the legal facts, they will be cursed and hated by the people, and the LORD will judge on them. Judges who punish the gulity, however, will be prosperous and enjoy good reputation.
The opposite of a Just society would be a tyrannical society; probably you have seen one? This would be a society that is ruled by the whims of a single man or a small group of elites who make decisions based on their own self-interest rather than the interest of the society as a whole.
Interestingly, the only way for a truly Just society to exist would be to have a “philosopher king”, a wise man who carefully made decisions based on the interests of the society at large. He didn’t think that a democracy by majority rule was very efficient at making the right decisions. Now, whom the public should turn to when there is an element of injustice in our society or government?
Justice and personal virtue (or morality) are two closely related, but distinct ideas. Justice could be thought of as the morality that we agree upon as a society and make into laws.
Of course, there are endless debates about what these laws should be, and they are constantly changing. One of the most famous moral philosophers, Immanuel Kant, sums it up by saying:
“The duty of virtue is essentially distinguished from the duty of justice in this respect; that it is morally possible to be externally compelled to the latter, whereas the former rests on free self-constraint only”.
Now DL & Group, come to the right path and join us the “Bansa Dayak Baru” here; teach your children on how they should live the right way and they will remember it all their life!

Aku enda berapa ingat, Nyangka semina mimit aja percent DAYAK Ibans nemu semua pekara/tentang semua tu. Ba mula ia, Aku nya siko ari sida. Aku nadai kiroh ka nama utai nyadi ba dunia tu, enggau utai ti di sekiling aku. Jadi kena kitai ngalaban/nagang enggai ka ia berlaku kali ti kedua, ka sida ti amat mudah ba-setuju lalu nga-mendar ka rang undang-undang ba pasal tanah adat menua kitai, DBs, patut nyimpan maioh agi penerang/penemu serta madah ngaggai kelebih agi ka sida menua pesisir ti tusah/ti merinsa awak ka sida nemu, Lalu berunding, nama utai ti dikerja permerintah di adil, ti enda baceping, di beri sama rata, pangawa di udah engau ti deka dikerja ngaggai sida menua pesisiri.
DBs, Kasih meh ka kitai Ibans, laban sida tu meh orang-orang ti mudah amat percaya runding/penemu ari sida ti deka amat kemula/nipu enggau janji manis ngaggai bangsa, ianya bangsa ti dalam menua Sarawak.
