Shattered Hopes and Broken Dream (Part 2 – Sarawak).

The British Members of Parliament have expressed their sympathies and concerns over the way Sarawakians and Sabahans have been treated in Malaysia after they have heard allegations and complaints from Sabah and Sarawak delegations.

“They are going to look into our allegations and complaints,” said Nicholas Bawin, leader of Sarawak delegation.

Britain will look into the allegation

According to Bawin, a member of the British Parliamentary Select Committees on Human Rights Virendra Sharma promised the Sabah and Sarawak delegations that the British MPs will look into the allegations.

“I will look into the allegations and bring them to a higher level,” Sharma, who is the Labour MP for Ealing, told Bawin and Daniel John Jambun of Sabah.

Equal partners we are not today

Bawin informed Members of the House of Commons that Sarawak agreed to join Sabah, Malaya and Singapore to the establishment of the Federation of Malaysia as equal partners when the federation was formed on 16 September 1963.

“We agreed because of the terms and conditions that were promised us,” said Bawin, when he presented a memorandum to the Commons on 9 March.

He said: “These terms and conditions which had been recorded by the Cobbold Commission Report 1962 and the Inter-Governmental Committee, 1962 had been stipulated in the 18-point Malaysia Agreement for Sarawak.

“These terms and conditions have also been included in the Federal Constitution to ensure such terms and conditions are entrenched in the Laws of the Nation.

“However, sad to say, such important promises and aspirations are forgotten when Malaysia began to grow up as a nation. Malaya became the most beneficial party to the Malaysia Agreement, while Sabah and Sarawak only received hand-outs from Kuala Lumpur, the Federal Government,” he said.

Trails of broken promises

“What remains are trails of broken promises,” said Bawin, former president of Sarawak Dayak National Union (SDNU), pointing out that Malaya being the main party behind the merger and formation of Malaysia has failed to honour its promises.

“When Sabah and Sarawak agreed to set up Malaysia, they joined as equal partners with Malaya. However, due to constitutional amendment made to Article 1(2) of the Federal Constitution, the position of Sabah and Sarawak has been relegated to a mere one of the 13 States of Malaysia,” he added.

On Language, Bawin said that the rigid enforcement and usage of the Malay language in schools and institutions of higher learning has invariably contributed to the decline in the standard of education in Malaysia.

“This has caused our children to suffer,” he said.

Borneonisation

Referring to Borneonisation of the civil service, he said that the reverse process of domination by Malayan officers has taken place. Almost all top civil service are dominated by Malayan officers down to the rank and file.

He went to say that the discriminatory approach, when issuing identity cards to Sarawakians particularly the natives, has caused misery and untold deprivations to the natives, including the deprivations to their rights as citizens.

Special position of natives of Sabah and Sarawak

He said the special positions of the natives of Sarawak must be safeguarded especially on land ownership, fair quota in civil services including armed forces and police personnel, fair access to scholarship and education and training, and fair access to licences and permits to trade and business.

“These special positions of the natives of Sarawak are almost forgotten. The natives have been systematically deprived of the ownership to their native customary rights lands. Now the government has stopped issuing land titles to native customary rights lands in preference to government driven and controlled land development schemes.

“Large areas of native customary rights lands have also been taken and given to big corporations to be developed into oil palm and tree planting plantations,” he said.

Bawin alleged: “The quota for the employment of natives in the service no longer applies in view of the flooding of civil service with Malayan officers as well as preference only to certain tribal groups.

Discrimination against Sarawak natives

“The giving of scholarships and educational grants are also very discriminatory. Children of native people are not given their dues when it comes to the award of scholarship and educational grants.

“The giving of licences and permits to trade and business is also very discriminatory. It is so difficult for natives of Sarawak to get licences and permits. On the other hand, certain groups get them easily. This has encouraged the rise of corruption and bribery.”

Constitutional safeguards removed

Talking of constitutional safeguards, Bawin said that due to the political dominance of Malayan parties in Malaysia, the constitutional safeguards for Sarawak have slowly been removed. The federal system of government is slowly diminishing and Malaysia is moving towards a unitary state. In the process, Sarawak is losing many of its state rights.

“After the withdrawal of Singapore from Malaysian entity, Sarawak and Sabah lost out to Malaya because the quota in Parliament allocated to Singapore was taken up mostly by Malaya. This has caused imbalance in power which tilted towards Malaya. This also caused domination of Parliament by Malaya.

Election commission in cohort with government to do gerrymandering

“The delineation of the parliamentary and state constituencies is also discriminatory to the natives of Sarawak. Although the Dayaks natives of Sarawak form about 50% of the State population, it is not reflected in the number of the constituencies, both parliament and stake allocated to them,” he said.

Bawin called on the British Members of Parliament to help Sarawak to relook into the Malaysia Agreement as Sarawak was once the British colony.-

    Only the fool will believe what DB say. The Malaysia nation was not formed yesterday. Malaysia was already enshrined in United Nations as a full sovereign country, having their set of rules, laws, regulation and self gomen. To this respect all countries in the charter shall never interfere with each other internal affairs with regard to own difference gomen policies.
    There is no human rights violation and massacre going in Malaysia except occasional shooting wild apes which NGO is so concerned but will not necessarily invite foreign intervention to change the existing rules.
    The British have enough troubles at their homeland and IRA was never solved until now.

    I have been wondering all this while till today why Malaysia has two (2) “National Independence Day”; 31st August 1957 & 16th Sept 1963?? Does that mean we have two (2) Malaysia?? Then which one is 1Malaysia?

    By the way, is Penang and Melaka part of the Federation of Malaya?

    Example No.1: ‘no human rights violation and massacre in Malaysia’ other than May 13, 1969 in Malaya which left 184 peoples dead.

    Example No.2: ‘no human rights violation and massacre in Malaysia’ other the Ulu Niah Tragedy, Miri, Sarawak as refreshed below;

    Tragedy erupted on 1st September 1999 afternoon when newspapers reported that four workers belonging to the Sarawak Oil Palm (SOP) subcontractor for land clearing died, allegedly killed and three injured in a clash with supposedly villagers of the disputed areas.

    The push to first log away forest and or then to supposedly developed Native Customary Rights (NCR) Land with mono-crop like palm oil moves on. More NCR land are taken, and more untold suffering is a direct result.

    But at what price for such push?

    Increasingly, such mode of development is showing every signs of victims while the proponents of such development and those benefiting or to benefit the most are looming behind with shadows only for people to wonder about.

    The very latest tragedy erupted on 1st September 1999 afternoon when newspapers reported that four workers belonging to the Sarawak Oil Palm (SOP) subcontractor for land clearing died, allegedly killed and three injured in a clash with supposedly villagers of the disputed areas. (Borneo Post, 2-9-1999)

    The four, aged between 25 and 35 years old, reportedly bearing slash wounds on their bodies, died at the scene. The four bodies were sent to the Miri Hospital where family members were waiting.

    The injured, one with serious head injury, were also admitted to the Miri hospital.

    Police said initial investigations indicated that 15 villagers from two longhouses of Rh. Busang and Rh. Bali might be involved in the clash.

    The case has been classified as multiple murders and the search for the suspects is continuing with senior police officers and paramilitary police forces at the scene.

    This land dispute is not the first of course. However, such tragedy tends to capture the print media’s front page attention with both English and Chinese papers fronting their 2nd September edition with the story.

    Another case in mind concerns the indigenous Iban communities of Sg Sebukut, Bakong, Miri Division, whereby on 20th December 1997, several villagers were shot by paramilitary police with M-16 riffles when the community people defended their NCR land against encroachment. Again, it was the so-called oil palm developmental project.

    Four days later however, Enyank Ak Gendang, 40, was pronounced dead and a post-mortem concluded that he died of a gun-shot wound to his head.

    Of course the latest case is but the second reported such incident but is by no mean the only type of consequence as a direct result of land disputes (The publication “Tanah Pengidup Kitai – Our Land is our Livelihood” documents more disputes and the other consequences)

    The latest Niah tragedy comes just after the affected communities had been confronted by gangsters and following that, numerous police reports were lodged hoping that the authorities would act on them to prevent any untold incidents.

    Following the police’s non-action, a letter was sent by the community people to the Inspector General of Police in Kuala Lumpur seeking higher authorities’ intervention.

    Such community initiatives unfortunately are still unable to prevent any untold incidents from happening.

    Beyond such occurrences lies the very fact that the State Government-initiated and supported land development should be reviewed before more such avoidable incidents occur.

    What price development indeed?

    There are many other incidents in East Malaysia.

    NOTES: Malaysia is a member of the British Commonwealth countries and also a member of the United Nations. MALAYSIA failed to honor the United Nations Declaration on the Rights of Indigenous Peoples (A/RES/61/295)2007!

    This is what DL ad hoc committee has been advocating….”initiate changes from with BN”.

    And I am pleased to announce today that after much pursuation from DL YDK agree to give priority in providing quality education especially in the rural areas as one of the six National Key Result Areas (NKRA).

    I hope DB will not oppose or sabortage attempt by DL group in providing the Dayaks community with quality education.

    What a shame, you are totally blind, deaf & dumb. And even worst you are not OKU? Why? Ingat chak kami ke ditu ukai apai-indai,aki-ini,aya-ibu,T.rumah, pengulu,pemancha,konselor Rumah Panjai. Kami pan bisi berajar Math, Sc, Physic, Chemistry enggau utai bukai baka nuan. Ingat chak kami tu ukai orang au belau’,ya ,anggok kepala, yes sir.

    Your sacrifice and the risk you are taking is very well accorded, knowing very well our own dayak people like Deo, TG, DL, Melintang, John Jamban are now working very hard with the mighty Bukit Aman to book you into their House of ISA.

    What a saddest part of our human evolution where “DUIT” plays very important roles.

    BN Sarawak under TMamud has indeed initiated changes from within BN to affect Dayaks NCR land that BN amended the land code so many times already to facilitate land grabbing manuevers for their GREED! I am sure your great aki -nenek are smiling from above. Congrats to DL and gang!
    BTW, since DL has initiated many changes from within BN, I suggest you change to the next world too, soon! This I believe is 100% achieveable…

    Our federal constitution says all persons are equal. There shall be no discrimination against citizens on the ground only of religion, race, descent or place of birth in the appointment to any office, or employment, the acquisition of property, carrying out on any trade, business, profession, vocation or employment.

    Our Dayak leaders, especially those in the government know about these equalities but they refused to speak out when their communities are feeling themselves marginalised, sidelined and not fairly treated. They are more concerned with their status and self-interests, drunk of power and wealth.

    They will deny all these, including dayaklama and his gangs. Can they prove it by statistics the breakdown by races on the number of the following subjects:-
    1. civil service
    2. armed forces
    3. police force
    4. scholarships
    5 education in colleges and universities
    6. licences to trade
    7. land titles
    In Sarawak, you will be surprised to see the minority monopoly all above.

    Brothers Dayakbaru, do you think that the Malaysian government is willing to entertain the complaints from the British Members of Parliament on this issue? UMNO and dayaklama gangs will say, ‘ Do not mingle with our country`s affairs. We have our own system how to run the government.”

    Even without the above statement, I myself been observed how we have been discriminated by the Malaya. I believe we must think very carefully and wisely who to vote for this coming election. Think for our future generation and be humble.
    And I have a Dream; Time will come ” The Dayaks will hold a post as Chief Minister and Governor of Sarawak” very soon!! I am waiting for that day.
